I sent my LBA off on the 5th so my plan was to give the bank until the 19th to reply and then proceed to the court case stage. The problem is that I phoned Customer services today and the woman I spoke to said that they intended to send a letter out to me on the 18th!! She also said she couldn't discuss the content of the letter as it hadn't been written yet!

 

Since I won't RECEIVE the letter till after the 19th Can I still proceed to court action even IF the bank sends the letter out before the cut off date of the 19th?

 

Also...I'm a wee bit worried about intending to sue my bank so close to xmas! I'm not sure how long it takes to get a court date after you apply? Does anyone know?

I was in my local court today trying to get my N1 in and they told me they are now listing for March and April.....

 

Get set for the long haul.

 

That in mind I'm sure it won't hurt your case to delay a day or so until the letter arrives...maybe you can use their failure to keep to deadlines against them in some way and it shows you're reasonable in awaiting their reply.....
