      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've sent you a private message - this includes the Local MP for Lichfield who is taking on Excel Parking and other parking tickets within Lichfield.

She's very helpful.

 

(Mods: I private messaged as the MP has requested this due to her having a new email address, which is currently redacted from the local council due to alot of abuse from idiots on the internet)

The website I referred to is a "history" of webpages where I found that 

 

LDC's very own "Visit Lichfield" website, still proceeded to show that Parking was still available at Backcester Lane on 25th May 2021 (Privacy page shows LDC as the data controller):

Based on this information the council's site was advertising the FREE for disabled incorrectly.

 

 

What you haven't told people here but to myself is that you've now contacted the Local MP who assisted myself in getting the ticket cancelled.

This site is a Cached/backup site.

(Way back machine is very handy in finding webpages that have changed)

 

It's predominantly clear on this page if you visited it on May 25th 2021 that parking was free for blue badge holders.

 

This was the link I used with the local councillor (already provided local councillor details previously & this link to LovelyN) to help revoke my parents ticket.

In post #48 the document from Excel only states Three Spires Shopping Centre Short Stay Car Park WS13 6JF.

There are 4 different Carparks

Two opposite each other on Gresley Row as soon as you turn into the road.

Google Map:

Find local businesses, view maps and get driving directions in Google Maps.

 

 

Follow the road round a short distance and.you have Backcester Lane (the Old Argos store) then a little further round from there you have Backcester Lane Lower about 25/50meters.

 

The signage from inside the carpark that is there now (unsure when installed)  displays.the actual car park name.

 

But each of these carparks are stated as Free to disabled as per the link i posted earlier back on 25th May 2021.

 

I think the price now for disabled drivers is £1 for an hour - but it's been a while since I've been up there. 

I was told that charging a disabled person for access by closer parking to something that an abled bodied person takes for granted is an infringement of disability act - don't know how true that is.

Unless your constantly on the internet and visit the Lichfield Councils maze of a website the only other place that I've found.on the internet which mentioned.the change from Free to Paid parking was a Lichfied Live report, with Liz little of Lichfield council - which was dated 26th February 2021 (https://lichfieldlive.co.uk/2021/02/26/shopping-centre-to-take-over-management-of-two-lichfield-car-parks/)

 

As you can see it states that the car park was to change from 1st March (UK non essential businesses reopened 12 April) 

But again the notice of change was not broadcasted anywhere & the council's visit Lichfield site was still promoting free parking nearly 3mths after the above news report.

You do also have the new rules on aggressive debt collecting & unreasonable fees on your side.

Max fine will be reduced from £100 to £50

Private car parks will also need to display proves more clearly.

 

If I was you I would take a trip to the car park (but for gods sake don't park there 😉)

and take photos from inside a vehicle from the disabled bays of signage you can see.

And also entering the car park as well.

 

As you have a blue badge, you are known to have a disability - that disability could be preventing you to raise your head above normal eye level (looking up to signage)

 

In addition to this, I'm sure you said you did previously pay but entered the wrong reg number?

If they do start proceedings you will need to request the print out from that ticket machine of all Registrations recorded (it will have part of the reg redacted) with the times of payment and amount.

You can then compare that with the entry time of the vehicle you were in to spot the payment - it will then be upto Excel to provide evidence that the incorrect Reg number you entered actually belonged to a vehicle that entered by photographic evidence. - but don't worry about that 

Like others I honestly can not see you have to worry about anything.
