What is the value of the claim? 100.00 ? Amount Claimed 125.00 court fees 35.00 legal rep fees 50.00  Total Amount 210.00 Have you moved since the issuance of the PCN?     • Obviously I'm ignorant and don't know the local area - but to me the images show the front of the car entering, and the rear of the car exiting, both times. On a second point - do you have any proof of your being elsewhere during the two times they reckon you were three hours in the car park? BTW, I've just done a search and we have 81 G24 threads apart from yours.  This is a company that huffs & puffs but very rarely does court.  In fact of the 81 cases, in 79 they haven't done court In one court case sadly the Cagger didn't defend and lost by default. In the second case G24 issued a court claim ...and then wet themselves and discontinued the case once the Cagger defended.
    • Often vehicle insurers will refuse to deal with third party property damage claims. They will by lack of willing rely on the third party to use their company Insurance  and the companies Insurance would try to reclaim through your Car Insurance. Agree with Ethel, but sometimes Insurance claims staff will try to avoid additional work.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks for any help.

I worked for a company until Apr 2015, and now have just received a claim form, from a "County court business centre" stating that I owe the company money. Apparently they overpaid me some salary, not that I can remember, so long ago.

 

This is the 1st corresondence regarding this.

How should I reply to this please?

They reckon it was £700, but with interest and now with costs it's near £1200.

 

If I own money, I owe money, not a problem, but somewhat baffled as to why after over 5yrs I suddenly get this claim form, and was not informed at the time.

 

Any advice/help with my defence would be very helpful.

This is my 1st correspondence.

And I was looking at the form wrong, it looks like CST Law are dealing it. There's a phone no, shall I ring them instead? I have no problem with the 700 but 300 interest is a bit cheeky as they haven't sent anything before.

Yes the claimant is Centrica and CST are seemingly the correspondence address.

 

Just spoke to CST and they reckon they sent 5 letters, one may of not got here, but 5? Not sure I believe that.

 

She's going to send any docs via email. And has put the case on hold.

So he's confirming that nothing has been received by him pre-action.

 

(OP - having dealt occasionally with recovering overpayments in a previous life, I am quite surprised that you've heard nothing at all about this in the last five years.  Normal practice would be to inform you immediately when the overpayment was discovered. 

 

If they ought to have an up-to-date address for you, sounds like they've sent previous correspondence to the wrong address.  Although that does raise the question how they've managed to get the correct address now).

 

Just to add - from my experience I would expect that a prudent employer paying a bonus scheme would use a formal system of informing employees how much quarterly/annual bonus they would be paid, and not just pay some unconfirmed ad hoc amount through payroll. 

 

If they don't have such a system in place, it makes it much easier for employees who have been overpaid to argue legitimately that they did not know they had been overpaid, and would have no reason to believe that they had been overpaid.

 

Just something to bear in mind.  In my experience, virtually all overpayments end up getting repaid, but I'd tell them to stuff the £300 interest as (1) it's their fault in the first place, and (2) they should have chased this up years ago - it's not your fault they've taken five years to get their act in order

Thanks all. Eventually heard back from CSW Law, stating Centrica require the full amount including interest and costs, basically I said no. I'll the pay inital amount overpaid, and I'll argue the extras. CSW came back and told me Centrica would accept the inital amount as a full and final payment, so I paid that and the case is closed.

 

Still nothing from the SAR's.

dx100uk; Good question, I paid as advised to an account: Credit Style Ltd". CSW law (Chloe) confirmed payment and that the case was closed. I'd spoken to her on a couple of occasions. Has to be said, very helpful, wether CSW get a cut is not know.
