I received my charges (£164) refund 3 days after the summons was issued and one of the charges was three weeks old so very quick turn around.

Usual letter this "should not be regarded as an admission of liability.. or weakness on our part as we consider charges fair and reasonable".

However the letter ends ominously "As it is clear that you do not accept terms and conditions for the operation of your account we will shortly be contacting you to discuss its future operation."

So I’m going to post a pre-emptive letter thanking them for payment blah blah and stating that any threats of the suspension of my account will be reported to the OFT and the banking ombudsman.

My view is that there is a thin line between organised crime and the way banks operate, if they can get away with it, they will.

If anyone else has been threatened with suspension I’d love to hear their story.

If they are agoing to call you to discuss the matter further, you could ask them to remove your shaddow overdraft limit, no doubt this could be the reason you incurred charges in the first place.

Mr Pym, A&L's managing director claims that it is a benefit to customers, in that it avoids embaressment! I think the only customers that benefit from that are the ones that are A&L shareholders.

I had the same letter with my cheque - I wrote back and said I presumed that they wished to discuss the application of LAWFUL charges to the account in the future. Haven't heard back from them yet !!!

I would think that they would be on very dodgy legal grounds trying to close the account of someone who has merely pointed out to them (as any good, honest citizen should !) that they are acting unlawfully.
