Gather all your information and give the ICO a ring, see what they say. Explain the problem as been resolved, but tell them you would still like to know as to whether a Breach of the DPA as occured. They might say file a complaint with them. If it can be proved that a company as Breached the DPA by confirmation of the ICO, then your in a stronger position to claim compensation through the courts imo.

Okay, I have called the ICO and explained that Lowells defaulted my credit file in Sep 07 when in fact they didn't buy the debt until Nov 07. I did explain that the default has been removed due to me complaining to Equifax about it. I have been informed by the ICO that there isn't anything they can do as the problem is now fixed and all I could do is maybe get in touch with Trading Standards. I was also told that I wouldn't be entitled to any compensation either.

Hi

 

I was defaulted by Monument in Dec 2007, but I requested all my late payment charges from them in April 2007. My credit file shows this as 'settled' as I won my charges back from them. However, I don't believe that this should show on my file and I also believe that defaulting a customer whilst the account is in dispute is unlawful. Is there any templates or advice that anyone can give for me to proceed with getting this removed?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
