    • you could have moved within that time in the same complex. have you this in writing - did you request a copy of the judgement CCJ AND Claimform from northants bulk?   it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right guys. smile have given me notice to close my accounts which is pure retaliatory action (it says "due to your continuous requests for refunds of charges") and this has messed me up big time. So, although I can't really afford it, I'm using some of my charges "bucket" money for court costs.......printing n1 now and will take it to the court now......only £30.00 right?

 

I can't even get a bloody overdraft due to these entries!!

The claimaint had a mobile phone contract with T-mobile prior to 2002 which ended April 2004.

The claimant’s personal information is being provided to third parties by the defendant, who is unable to establish any contractual or legal right to do so, despite several requests by the claimant.

The Claimant served a statutory notice on the defendant under sections 10 and 12 of the Data Protection Act 1998 on the 2nd October 2006 of which the defendant has refused to comply. The defendant is therefore in breach of the claimant’s rights under the Act.

Furthermore, it is the Claimant's contention that the defendant’s perceived right to arbitrarily choose to extend the length of the said contract without the Claimant's knowledge or agreement would be unlawful and unenforceable under the provisions of the Unfair Terms in Consumer Contracts Regulations (1999).

The claimant seeks to enforce the Statutory Notice served on the defendant on the 2nd October 2006, to cease disclosure of any personal data to any third party including, but not restricted to: Equifax plc, Experian Ltd and Callcredit plc.

The claimant also seeks costs of £200 for postage, research and his time in having to bring this matter to court.

I would go for it;) But bear in mind that you'll have to (if it gets that far) show the Judge why you are claiming £200......ask yourself wether it's fair and reasonable? If you asked for as little as possible then the Judge wouldn't really have any problems with it (IMHO).

Good point about the £200.00 - I've sepnt all day today trying to find the sodding court, I'm wet rite through, only for them to say that they don't take debit cards then I went and got the dosh, then I had filled in the form wrong, bloody hell - I'm a donut....

 

I can't really change it now though - I have to get back over there!!

Aw thanks Willow, much appreciated. OK, so what did I find on my doorstep today? A notice of issue form the Court and an acknowledgement of service (literally on the same day) from T-Mobile, they intend to defend the whole claim....gues I just wait for their defence now?

 

I am actualyl bricking it now, but will see what they have to say - I'll post the defence etc as soon as I get it!!

Absolutely -haven't had a chance to catch up on it the last few days - computer at home broken and not had the time to read it all, so fallen a bit behind, but not much!!
