    • Apologies for the short responses today, I have been in work all day so have had to duck out of meetings and respond to you on my mobile.  I am feeling extremely overwhelmed by all of this, it has been hanging over me for over 3 years now since I first discovered the CCJ on my file.   I am a single mum of two little ones so really struggling to find my way through this.  I paid a solicitor to help me set the CCJ aside and it used up every penny of my savings to so.  I can't afford to pay for anymore legal help but feel completely out of my depth.  My witness statement needs to be with the court and claimant by Wednesday and I am terrified of getting it wrong and losing after everything they have put me through.    I really appreciate all of your posts, and would be so so thankful if you could help me finalise my witness statement to ensure I have got all of my points across and that I have not included anything that could go against me. Thank you
    • I am sorry about getting your status mixed up.  I have noticed one thing. On their claim they are only pursuing you as the keeper-I think it is  on their Point C that the driver did not pay , so the keeper is liable. So on your No keeper Liability section  You may need to add 8a after 8.  8a  . It is trite Law that the driver and the keeper cannot be regarded  as the same person and the claimant has failed to offer any proof who was driving.  BY  pursuing the keeper . when the PCN does not comply with PoFA must mean that their claim fails.  
    • Thanks for being so kind (I mean they took the tape off me obviously and wouldn’t let me pay for it) but do you think they might tell this company to leave me alone? Or just ignore me. I sent it tracked. I cannot get a criminal record and of course don’t see why I should. It was an error. Thanks for actually taking time out to reply to me. So I’m expecting a few horrid letters? One which will say letter before something but as long as it doesn’t say letter before action I’m ok?   if B&Q take me to court will I be able to pay this fine before anything bad would happen.    It’s all a shame as it means I’ll have to make excuses now if it’s every suggested I go into B&Q but I guess that’s the situation I’ve found myself in.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone, I recieved a reply to my letter before action today and heres what it says.........

 

I am sorry to learn that you are unhappy with the charges applied to your account.

 

We're keen to deal with your concerns as quickly as possible. A customer Relations Manager will investigate the points you have raised and you will recieve a reply shortly, but certainly no later than 4 weeks.

 

You will find enclosed a copy of our leaflet, Which tells you how we will handle your complaint.

 

Your concerns will be delt with as quickly as possible.

 

 

 

So do i wait another 4 weeks before i take it further?

 

Any help would be very much appreciated.

You work to your timetable not the bank's! Don't wait another 4 weeks just to get a buzz-off letter ;) If you gave them 14 days from receipt of your LBA then when that time is up it's time for MCOL :) so go for it and good luck. Any more questions, just ask :)

If you've sent them the LBA it says that if they do not respond positively you will commence court action without further notice ;)

i have just read it back, and yes ur right!! :lol:

 

So next step it is!! Just hope it doesnt actually go to court!!

 

Fingers crossed it will be settled soon.
