    • Ok, so just been to see my friend, she still has her head firmly in the sand and had a pile of unopened post, thankfully nothing serious apart from this case!    In answer to your question it says N24 General Directions Order at the bottom of the page, then on page 2 where the line says "As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court) " this is N271 Notice of transfer of proceedings.  Within the stack of letters I found 2 from Kearns Solicitors,    02-12-2022 Document pack with covering letter stating under the s78 CCA please see enclosed  1) A copy of the executed Credit Agreement, 2)  A copy of the terms & conditions 3) A copy of the varied terms & conditions applicable at termination / assignment, and  4) A statement regarding the conduct of your account as requested by s78(1)(a) to (c)  (Would you like me to describe the documents attached?)   18-02-2023 Generic letter asking for her to contact them to discuss settlement or they will take to court for further legal action. 
    • well you made the cardinal sin by phoning these scammers at least once so their persistence could go on. however you are new so there you go. you never ever ever phone any of these likes of scammers on these fake schemes that seem plausible.  just like a DCA chasing any old debt .. they are NOT BAILIFFS and have  ZERO legal powers to actually do anything. dx  
    • Okay understood now just based on personal experience how long does this go on for 
    • civil recovery schemes run by the likes of RLP DWF etc etc are a scam. totally IGNORE EVERYTHING. no if's or but's dx  
    • I’m 17 years old and Received 2 letters from dwf with my name spelt wrong and they are asking for for £230.40. I rang dwf civil recovery the first time upon taking advice from citizens advice to explain to delay to deadline as I was in the process of receiving advice which wasn’t much help. When that deadline was done I then called again to delay the deadline as I’m struggling financially and it’s lot of money they are asking for and I tried to dispute the cost to which they said okay we will delay it another 7 days for you to dispute the cost but I asked them how do I dispute this to you or Sainsbury’s and they said “we can’t advise you on this matter” I’ve read a lot of threads saying to ignore them but I was unsure now as I’ve made contact and have tried to dispute the payment and pay it which might mean I have admitted. Would they just persist harder and take me to court eventually or file for a ccj.   I would like to ignore them still but I would like to send a strong email so they know I’m clued up and then ignore them. I also want to pay the reasonable amount and get this matter solved. any advice on the law or similar situations are helpful when I called them I asked for an itemised bill. £101 stolen goods  ( supposedly caught me because they watched me on cctv over the duration of the week) also why did they not stop me in the first day. £20.40 recovered goods £150 security costs     Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I have just had bh at my door demading goods or payment. I took out hp for xbox360 over 12 mths back in late feb, so have paid over half. I am 3 wks behind td them I wud pay upbto date on tue but they say they need to pay my missed payments plus late charge by tomorrow dinner time im in full reciept of benefits ca they do this when I am over half way through hp agreement

As far as i,m aware they can ask for the goods back.But they will need a court order to do so also do not let them in your house they have no right to do so unless they are with a court bailiff.

So I think fom reading down other post todo with bh I can refuse to let them take the goods and go in tue and bring my account bk upto date as noway I can make payment they require tomoz as only get carers allowence. Am I right in thinking this.

Here you go, CAB fact sheet on Hire Purchase, if you follow the links you will see that if you have paid more than one third then they cannot simply turn up and demand the goods - they need a court order.

 

Print off the fact sheet. If they turn up, then show them the fact sheet and tell them to go away.

can honestly say this will be first and last thing I have through them.

 

Good on you....steer well clear in the future even more so following their latest wheeze to include their "insurances" automatically and hike the interest rate to an eye watering rate.

 

Have you thought of looking at a credit union if you need to finance other goods?

yeh and now the double the apr and from 4th november they increase late payment charge to £5.50 per agreement i think they have lost the plot but by all accounts the finance part is based in malta and we all know whats happening in malta

Think im just gonna stick to living within my means n reducing my outgoings eg drstep lenders bh & cash converters bringing them all down slowly but surley but much thanks for advise 8)

Lets hope so im glad I only had one item off them but still am gonna have paid over £600 for xbox 360 I could of gt for half that price in away glad this happened as was contemplating having an ottoman bed through them but saw price and that made me check online and there cat price is almost 4x the price you would pay online .

well at least you have learned by mistakes it only way to learn BH have got away with it for 2 long and now its time for everyone to stop shopping with them and then its only 1 way for them.

Yes its just unfortunate for those that have had thousands of pounds worth of goods through them or necessary items. Some of other post/feeds on hear just make u so mad how can a company get away with this for so long, surely there has to be a way of legally bringin this to the knowledge of all.Only not everyone would think to put a search in google n find this site and ask for help, they will just keep bending to these bullies demands and dobt even get me started on there customer relations there staff have to be some of the rudest I have ever had to deal with

Well bh turned up at my dr, I wouldnt ususlly not pay like this but it has been a knock on effect from an unauthorised payment been took out of bank over 3 weeks ago which has left me having to catch up on priority debts untill matter is sorted and money returned this I explaind to the two girls who came sat and said full payment or we take the goods. I also told them that I will bring my account up to date tomorrow but they wouldnt except this eith so I was ready for them to come out agin today and when they did I opened dr gave the letter explaing how with out any written correspondence from bh let alone anotice of default or the ones they send out about late fees they had no legal right to say they would take goods and stated that I will only correspond with them in writting and not to knock at my door again without permission and promtly closed dr. They stood shouting for a while then sat in van for aprox 5 mins then left.

Will see if anything else happens today and what there attitudes are like when I go instore tomorrow to pay up to date.

That type of behaviour should be stopped. I would suggest you make a complaint to the Office of Fair Trading.

The must be some law against this kind of behaviour.Bully boy tactics is not right they go on worse than loan sharks i would suggest you try to get hold of a little video camera to record such behaviour then they wouldnt be able to get away with it.I would definatley contact OFT or trading standards they need closing down.The article above was interesting reading

Yes I agree totally. I am just greatfull I have only had one small relative cheap item through them if this is how they persue people my weekly payments are only 12. Odd and have missed 4 wks to date and they are threatening to tske goods I have not received any letters concerning missed payments or stating that they require the goods back nor have I received a default notice. Surly this is bad business practice. What do I need to include in a complaint to the oft how should it be worded and to where do I send the compkaint would eith of you knw .

It also seems strange that they have switched from vans with bh signwritting to plan vans now not sure for what reasons and weather thats just my branch or across company another thing I can rember them breifly outlining when I took out agrement something about yellow money have also heard mention of this instire any ideas what this is.

They are not allowed to bully/harass you that is for sure.

 

If you log on to the OFT website, there is a complaint /contact us/section.

 

You would pretty much tell the story as you have told us... condensed though - perhaps using bullet points.

 

You have missed a payment(s) - you have made contact asking for time to pay/assistance.

 

You have been threatened on your own doorstep, etc, etc.

Ok thank you so mech again I really hope somthing happens soon within the laws to stop this company from targeting those who they obviously think dont or wont complain about treatment or knw ther rights and insist on them being respected just because you got bad credit or no credit rating dosent make you any less of a person or afraid to stand up for your rights and companies shouldnt be alkowed to take advantage of such individuals.
