      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ill start from the beginging. I Purchased a car(carcraft) oround late march 2005 through black horse finance. Car was 6k turned out i was paying around 18k back.

Bought the car and it was the worst thing i ever did. Fault upon fault up on fault. Took it back numerous times just to be fobbed off. In the end after paying £304pcm for around a year i took the car back to carcraft left it with them wioth logbook keys everything and canceled my standing order.

Time went on which at the time i was 18 so decided to ignore. (stupidly as im paying for it now im wanting a mortgage)

Got a letter saying thanks for your payment was around the £1000 mark 100%wasnt me or anyone else who paid. So a fake entry.

Blackhorse sold the debt of around £18500 to apex who found my ny address demanding money ect. Ive not had any sort of contact with apex in over 5years!

Went to the citizens advice about my situation wanting to get my experian credit report cleared so i could move on but it seems that apex have been putting fake payments to themselfs from me in order to keep my account alive and not go over the 5years before my debt clears?? citizens advice told me to hold on as they thought it would be wiped but apears not as i had experian chase it for me.

Has anyone any ideas of what i can do?

Ive not guot much paperwork to go by as ive moved twice since and over 5 years have passed. I dont want to get intouch wqith apex as then i would have started comunication with them and be back to square one.

I would have had no broblem paying for it if the car was in good working order but it wasnt.

I think i also paid for ppi with the origional finance but as i were self employed it was pointless. (thats another thread proberly) haha

 

Any info and advice would be hugely appreciated.

This sounds incredible, how are Apex recording the payments, each month?

How long has the default left to run?

The default should definatly be over thats what i dont understand. I no i have never made payment or contacted them since 2006 for definate. I moved house 22nd sept 2006 and never told them or got intouch with them. They found my address out but i never actually made contact to them. I think for sure 2005 would be the last time.

Im going to have to get a new experian credit report and check it out and have a look. The cheek nof them is terrible.

This is best dealt with a FORMAL COMPLAINT which means that the compliant must be properly investigated and answered.

FORMAL COMPLAINT:

Sir/Madam,

 

I refer to an alleged debt for £xxxxx .xx which Apex Credit Management are attempting to pursue there are some serious matters that must be addressed.

 

It has become apparent that payments are being /have been allocated to this account which have NOT been made by me nor have I authorised any 3rd party to make such payments.

 

I can only draw the following conclusions from the data available to me:

 

1. Apex Credit Management has in some way confused this alleged debt with another account.

2. Black Horse Finance has provide incorrect data.

3. More seriously it appears that Apex may have been applying spurious payments to this account in an attempt to prevent the alleged debt becoming Statute Barred thus extending the period of time remaining for collection activity.

4. Had these spurious alleged payments not been applied to the account any entry on credit files would now have been removed.

 

I require a FULL explanation of the conduct of this account since Apex Credit Management acquired the account including but not limited to the exact details of any payments allegedly made to the account, the method of payment used, the identity of the person or persons making the payments, any banking details relevant to the alleged payments.

 

For clarification and the avoidance of any misunderstanding take note: This Communication is A FORMAL COMPLAINT and your response is required within 56 days from the date hereon.

This communication IS NOT an admission of any liability to Apex Credit Management and the account is formally disputed an I reserve the right to report the conduct of Apex Credit Services to ALL the relevant regulators including the Financial Ombudsman Service which will of course involve Apex in further costs.

 

Recorded delivery, check receipt.

thanks for the template letter i will get this sent off asap. The only issue i have is 1 i dont no now the outstanding amount as this were upto 5 years ago so i can remember it was around 18k. I dont have any letters from them with my refrence on. and number 2 is i am now contacting them so wont my 5 years start again as i have made contact?

hi brig sorry for the late reply ive been off my feet. moving house ect so finally had time to sit down and try sort out my credit. Just one question. in the template youve told me to put a reference number. as this was so long ago i dont actually have any reference number to use so what should i put? ive put start date of the debt and the amount and the address that it was registered to?

Also a little bit worried that if i send this letter it will start the whole thing off again like the calls letters ect. As ive been reading a few things that seem to send a letter and then all they do is start getting fresh new letters from apex. thanks again

Hello Aiden,

 

Once they receive such a letter it means that they must investigate the matter fully and respond within 56 days.

In my opinion this will just drag on and keep coming back, your decision Aiden.

 

I'll keep an eye on the thread in case you need further help.
