hi forum,

i am at the final stages of my claim against rbos, my court date is a week on friday but i feel a little unprepared: no settlement offer has been made since the date was set and i can only draw from this that the bank will stand their ground and fight. ive read through similar threads on this group but cant find anyone who has posted about this stage- im really just looking for advice from anyone who has been there already. im claiming in scotland if it helps.

 

can i also mention that this forum has been a god-send, the wealth of information shared will hopefully send the message that we, the consumer, wont lie down any more. look forward to your replies! chris

a few people have actually gotten to court - only to be settled before actually going in. Plenty time yet, but its always worthwile preparing "just in case".

8/11/06 - claim settled

17/11 claim #2 started - incl creditcard

30/11 - CC statements received

31/11 - Prelims issued - RBS paying up, only M/C to go)

any clues as to what information i should bring on the day-just in case? ive read that other claimants have brought recordings to be played and are ready to quote consumer law at the drop of a hat!!

Firstly, make sure you have copies of all documentation (sar, prelim, lba etc)

 

If they want to present an argument (which is unlikely) - dont forget your main issue is that the charges are not justifiable due to them not being commensurate with the expense incurred by the Bank and as such are deemed penalties. It is the banks responsibility to show their costings and how they arrive at the figures. This is where they will fall down.

 

In terms of back up info and law etc, it is all in the forum header and I would really spend some time going through the other threads where people have been as far as you (there are loads).

 

I will have another look through and see if I can dig some out - there are dozens - I just cant remember right now as I have been glued to this site for weeks!
