cheers weej! any clues as to what information i should bring on the day-just in case? ive read that other claimants have brought recordings to be played and are ready to quote consumer law at the drop of a hat!! honestly, anything you got-i want. chris -
hi forum, i am at the final stages of my claim against rbos, my court date is a week on friday but i feel a little unprepared: no settlement offer has been made since the date was set and i can only draw from this that the bank will stand their ground and fight. ive read through similar threads on this group but cant find anyone who has posted about this stage- im really just looking for advice from anyone who has been there already. im claiming in scotland if it helps. can i also mention that this forum has been a god-send, the wealth of information shared will hopefully send the message that we, the consumer, wont lie down any more. look forward to your replies! chris

Hi there I am at the small claim stage and have all the paperwork etc..... I have a couple of queries and hope someone can help me out. 1) Should my claim total include the 8% interest or should I claim only my charges? As the max amount claimed is £750.00 I will have to submit 3 claims, if I am to add on the 8% in the claim total I will need to do 4 claims. 2) I have copied a spreadsheet from the library to include with my claim. It seems to go into more detail than just date, amount charged and is asking for interest date, interst charged, account balance at interest date and interest on penalties. Do I have to include everything I have mentioned in number 2 or has anyone just sent the date and amount details? Hope someone can give me some guidelines as I don't won't to mess up at this last stage. Thanks

Royal Bank of Scotland Hi I am looking for £2000 in charges. I have been offered £600 and did my LBA on Friday 14th July. Since then I have received a letter from the bank stating that the offer still stand but under no circumstances will they increase the offer..........so I am now at the small claims stage. I just need a bit of help with the following: 1) Who is the small claim against, my branch or is there a head office address that it should be posted to and if so does anyone have this? 2) What info do I put on the claim form, is there a template for this or is there any sort of legal jargon that I must include, not sure where to start with that?? 3) The small claim book you can purchase off this site by Patricia Pearl does this apply to the small claims procedure in Scotland? Any help would be very much appreciated. Many thanks.

Offered a Partial Refund - should I take it?

Thanks for the advice. Have decided not to take it and have drafted a reply to them stating I am looking for full refund within 14 days or will proceed to small claims court. -
I have just been offered a partial refund as a goodwill gesture of £600. The total I am looking for is £2000. I have not sent my LBA yet as this is the result of my prelim letter. I am not sure whether to send the LBA or to take the money an run!! Also If I am to send the LBA should I change the wording slightly?? Anybody got any advice? Pls help:confused: Tks

Looking for a bit of advice if anyone can help. I have sent the prelim letter to the RBS (my local branch) which I did get a response within the 14 days. The response was that they are regulated by the FSA and are allowed up to 8 weeks to deal with a complaint and that the 14 days I had given them was not enough time. They stuck the usual bumf forms in about how they deal with complaints. Are they correct in this or should I go ahead and send the LBA letter anyway? Tks
