    • I'm not quite out of the woods yet. The email they sent me also said that I have £290 of arrears and it has been passed onto their collections department. If anything my account should be £10 in credit.  They haven't taken into account the trainers that were returned back in October. The other items have been credited to my account so it looks like I've still got work to do.  They are not very quick to reply to emails, although I've only sent one trying to find more information, and I have no idea what happens next. Half of me want's to get it sorted properly the other half just wants it over with, if that means a default then so be it. 
    • No. It's a public (council maintained) road with some houses in it.   Some other houses back onto it too and those owners have right of way down the road to access the back of their properties.  Theres a few garages with private osp - so one drives out the garage, over the osp, and onto the public side road and then out on to the public main road.  Irrespective of whether the garages are used - the local businesses parking their cars on the private osp are ostensibly preventing cars from accessing the public roads.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I couldn't even hold a conversation properly as speaking leaves me breathless. The fatigue and pain from even minor physical effort renders me completely unable to do much at all.

 

I also have a psychologist report stating that I have an inability to interact with others, and I'm unable to trust anyone. I have photographs of the severe self harm I have carried out in the depths of depression, showing my upper thigh having been stabbed dozens of times with a scalpel and Stanley knife. That was just prior to one of many suicide attempts. Something tells me I'm going to be revisiting that particular practice in the near future:frown:

Let me just echo dibadabables post. You are not on your own, you have CAG behind you. Have a look at posts by ReaUK and estellyn, you'll see how, with the help and advice of CAG, people who are in a real hole, can win and live on and then give good advice to others. I wish you all the best with your case. Help me out, please put the stanley knife back in your toolbox, If you feel that way just post on CAG instead, you have a lot of friends here to help you.

pitcher, thanks for the support, but don't worry, it was a few years ago I was that low, I was just making the point that this government and their persecution of the vulnerable could be the thing which pushes me back to that point...but it's not something I'm planning.

 

I'll have to try and get the rest of the form filled today and hopefully leave nothing out, and nothing to chance

Well, all sent off by Special Delivery yesterday and I have the receipt if it doesn't reach them by Wednesday...all in the lap of the Gods now!

Well done Stewey. This maybe all you need to do but It's not in the lap of the gods. It's in the hands of ATOS, not quite the same thing!

From what you've posted I think it should be a "no contest" decision in favor of your good self. If you get zero points (not likely), please don't cave in. You will find yourself in the same place as countless CAGers have found themselves in. You will find lots of support and first class advice here, that's what all the good people at CAG do. You're not alone.

Thanks pitcher, I have an important medical test in hospital tomorrow which I'm having filmed as they carry it out just so that any future appeals tribunal will be able to see how little physical activity I'm able to do before becoming incapacitated. There'll be a medical report but I asked the consultant if I could have someone film it too and he was fine with that.

 

Anyone know how long they'll take to come to a decision and how long DWP will take to inform me, and if the worst happens, cut my money?

I've not heard of anyone going to the lengths you have gone to, in fighting your case! Well done, it can't have been easy for you. If you don't get what you deserve then you could make a TV documentary about it. I think you are onto a winner (I mean ,only what you are entitled to) . Please be aweare a lot of good people, like yourself have been had over by ATOS. It's not the end of the world. It may hit you hard but all help is here. Hope for the best (just what you are entitled to) but if you have to appeal, you will have a story that will show the shame ATOS is.

Well, that's 2 weeks since they received my ESA50 and I haven't heard a word. Starting to wonder if that's a good thing or a bad thing, or whether it has no significance at all :|

two weeks may seem like a life time but you have sent in a lot of information. I think ATOS will contact any or all the consultants you may have mentioned on your ESA50 form. This takes time, plus your consultants may well take their very own time in responding. Have a look at some of the threads in the benefits & HMRC section and I think you will see ATOS works at its own pace.

From experience, they can take ages to respond. When I sent mine, I never got a letter (does anyone?) saying it's been received.

Just catching up with your thread and wanted to wish you all the best. As said, it can take quite a while - sometimes months - before you hear back about the ESA50. By the way, very very impressed with your idea of video recording your hospital appointment, that will be a big help if it's needed. And a pat on the back to your Consultant for being happy with it.

Oh, I noticed your earlier comment about it being 'in the lap of the Gods'. I see you have a touch of dyslexia. It's with ATOS. Didn't you mean it's 'in the lap of the dogs'? :lol:

stewey has done so much to get what is deserved. If It takes time, then I'd look on it as ATOS doing their job. With so much work, video and all, it should be a forgone conclusion.

ATOS may still **** it up. If so, this is the best site for advice and support.

I'm elated...I never heard from Atos, but just got post from DWP telling me I've been placed in the support group...no medical requested by Atos...a huge weight off my mind! (I've even ended up with nearly £5 a week more money too!)

 

I do feel a bit guilty though as I know so many others are not getting the results they deserve...keep fighting people Herr Duncan Smitz is bound to be gone soon anyway!

 

Thank you to everyone who posted advice and the moral support. It did give me the will to fight and not just give up.

 

I'll keep coming on and hopefully be able to offer some advice and support to others. Need to digest this now, maybe pinch myself very hard ;)
