    • its SJPN you simply fill the form in pleading not guilty. you will then be sent a later court date by letter to appear at your local magistrates court or the DVLA will might even drop the whole case. if you want ,fill in the small section of the form too, simply stating that payment for said road tax was cancelled and latterly reclaimed as a new DD was already in place. hence i double paid for said disputed period of the claim. just to be 1000% sure. please scan to PDF the page that states what you have been summoned for.  read upload carefully 
    • HI DX Yes check it every month , after I reinstated the second DD I was checking every week. Also checked my bank statements and each payment has cleared. When responding to the court claim does it need to be in specific terms ? Or laid out in a certain format? Or is it just a case of putting down in writing how I have explained it on CAG?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is my first post.

Unfortunately due to financial difficulties about two years ago because I did not have a job, I fell behind with my mortgage payments. The arrears were over £6000 and Chelsea obtained a possession order, suspended on payment of £100 per month in addition to current rent.

I found a job and maintained payments as ordered. Unfortunately, I was unable to make the December 2012 payment because I had some financial problems which needed sorting out. Late last month Chelsea's solicitors wrote to me stating that they have applied to court for eviction date. I then paid the December payment and confirmed I can make the January payment by end of this week but they are insisting on payment of at least £2500 (half the current arrears) before they would suspend the eviction. I have phoned both Chelsea and their solicitors several times pleading with them to agree to cancel the eviction on payment of the January instalment (I even sent them last week a full statement of my income/expenditure showing I cannot afford to pay the amount they are demanding) but they have refused.

Now I have received an eviction date for 19 February and I have been advised by CAB to apply to have the warrant suspended, but I have no idea how to do this or any confidence that it would be successful. They cannot help me because I'm working.

I am very worried sick about losing my home. I know my financial problems are now behind me and I can maintain the normal monthly payments as I work full time, but I cannot afford to pay the amount Chelsea are seeking from me at this time.

Can you good people please give me some advice?

If you need help with the wording of a statement for Q.10 of the form, please ask.

OK, let me know if you need help with anything. You will have to get the form to the court tomorrow if possible, there is a fee of £40 to pay when you take it in and you will need to pay in cash.

I plan to lodge it tomorrow morning; started drafting the statement. Just a quick question, does it affect my prospects if my financial difficulties were not caused by unemployment but by other unforseen but urgent and necessary financial expenses? I missed two payments before they started the action and I have since made one of those payments.

Hi, if you have a valid reason for missing the payments i.e. boiler or car breaking down or some other disaster you should be OK. Also if you can show that you have reduced the arrears significantly since the suspended possession order that will also help your case.

How much have you reduced the arrears by since the suspended possession order ?

How many years are left on your mortgage ?

Is the property jointly owned

Are there any children living in the property?

Hi, I have replied to your email. Make sure you staple your budget sheet to the N244 securely and take a photocopy of it all before handing it in to the court so you have a set to refer to in the hearing.

 

Do you have a statement showing all the payments you have made since the suspended order ?
