    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

you need to look at each refinance

 

say loan 2

 

I believe it was refinanced by loan 4 so payment stoppage tallies with what I've got dec 97

 

here is daves spread which is correct

 

the claim to date should be the same dec 97

 

so do the same for loan 4 & 5

 

in your letter you need to ref the fact that although PPI was charged on loan 1 and loan 3

you do not have enough info to contruct a reclaim for those

but they need to offer redress too.

 

 

TBH: this is a 'lets put in a claim and see' exercise.

 

they might comeback revealing additional data in their calculations.

 

at this present stage I would treat this as a somewhat 'speculative claim'

 

IMHO you are entitled to a lot lot more.

 

but with the info available

this is mine & IMS21's 'best guess'

 

make SURe you fill out the FOS cq mentioning ALL the accounts

 

the issues with loan 1 & 3

 

and the fact [the ONLY REASON you tell them}

 

you were told in no uncertain terms that you MUST have the insurances each time by the Branch staff.

Thanks, if you could please. It would be good to see. However,if you remember, in my post on page 5 I was not going to use that reason as they had paperwork signed by us to say that we understood the insurances were optional and you said it was quite damning for us.

I'm getting really muddled with the spreadsheets right now. What is the date that should be in the 'Claim To' Section. Is it todays date or the date the loan was refinanced? Sorry but I just can't get my head around it!

 

Loan 2 was dated 15/3/97, I take it the first payment was taken around a month later

Loan 3 was dated 20/1/96 and started on 3/3/96

Loan 4 was dated 29/11/97 and started on 3/1/98

Loan 5 was dated 23/8/99 and started on 4/10/99

Loan 6 was dated 27/6/02 and started on 29/7/02

Hi, should the claim to date be todays date and not the dates you have entered, If I'm right it will make your claim alot bigger dx will know

I thought it was to today's date, but in dx's earlier post he mentions that the claim to date should be the date the loan was refinanced. I'm in no position to understand why, I just do as I'm told, lol!

Well today I received a letter from HFC upholding my complaint on loan 2, 4 and 5.

 

They have offered me nearly £18,000!

 

They say that for loans 1 and 3 they do not have enough information.

 

They say that they need statements to prove that we paid PPI all through the loans and didn't cancel it.

 

Also they state again that loan 6 did not include PPI, but are ignoring the fact that it would have rolled over into this loan.

 

I'm going to scan the offer letter for you to look at in a minute so you can let me know whether or not to accept the offer on these 3.

 

We could certainly do with that kind of money right now!

Plus interest at 8% = £1,537.49

Excess payments from account 641 = £524.62

Plus interest on excess payments = £613.89

 

Loan 5 (acc 032)

Premiums paid from 04/10/99 to 04/06/02 = £2,308.55

Plus interest at 8% = £2,223.89

Excess payments made from account 035 = £1,544.50

Interest on excess payments = £1,523.52

 

Loan 6 (acc 296)

Excess payments made from account 032 = £2,308.55

Interest on excess payments at 8% = £1,479.38

 

Paid PPI and interest = £4719.67

8% compensation on PPI payments made = £5273.56

Excess payments made from previous accounts = £4377.67

8% compensation on payments made = £3616.79

Total redress = £17,987.69

 

Just realised that they have included the excess payments into loan 6 in this.

cant read the figure either scan is very pixelated.

but the usual crap that they 'automatically assume' it has been destroyed

so wont look as its outside of 6yrs

I would say its worth sending them to FOS

- I wold also be tempted to go back to HFC and invite them to make an offer in respect of he other 2 loans based upon the average redress of the others.

 

They will most likely say no but it will demonstrate to FOS you have made every effort to resolve matters reasonable before approaching them.

 

More importantly if HFC try to claim that you have accepted the offer in full and final on all 6 loans it will give you written evidence that this is not the case
