      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

after some considerable time we have finally managed to throw off the shackles of Welcome finance. I went to my local office today and personally served them with A Subject Access Request, which I advised the manager she might like to forward it to head office along with my cheque for the £10 fee?

I was wondering if anyone else had had any dealings with Welcome and have taken action against them similar to mine. It would be great to get some feedback from anyone who has and what stage they are at or the conclusion of their action?

Hi Sandy,

I took in my S.A.R - (Subject Access Request) today personally and gave it to the manager. She seemed ( or made out she knew what it was all about) and was probably on the phone to head office as soon as I left. They have charged me and others, I believe, extorsionate rates and prey on people who have had some adverse history financially in the past. Well, time for the fat cats to be placed on a diet ;-)

Hi guys,

I'm not sure how you stand on the interest issue, however, if part of a contract is deemed void then surely the whole contract would be too?? something worth looking into dont you think?

My gripe with them is that we paid off out loan with tweo large payments but had late payment charges etc levied against us although we were still waiting for the money to be sent to them from another finance company. Also charged at least an extra £2000 or there abouts as penalties for paying off early redemption figure?

Will find out exactly how much soon!! ;-)

What about hitting them with the unfair contracts ??? If you could prove to the court that you signed the dodgy contract under extreme pressure and hardship and you couldnt get help anywhere else financially and you felt you had no where or no-one to turn to to help you out of the financial mess you was in, assuming you weas in that situation of course.

I personally issued them with an SAR yesterday, the local office looked like they didnt know what to do with it, the manager made out she did which was quite funny really. Just waiting for the next 40 days to find out just how much they have taken off me in unlawful charges then the fun begins again ;-)

Mine was a personal loan and hopefully when I get back the details of my account from them they will be paying me back all their extortionate charges within 6 wks ;-)

keep us posted on here and let us know how you get on, I will do likewise for all you Welcome fighters :-D Dont forget the cheque for £10 when you take in your SAR Tony. you will probably find, like I did that the local branch wont deal with it they send it on to head office. Seems they will /have been getting quite a few ;-)

Thats typical Welcome though isnt it? I made numerous calls to my local branch in relation to my payments and having paid off a substantial ammount wanted them to reduce my payments, would they ring me back?? I bet you can guess the answer to that!

Well done Northland, seems we have opened up a big can of worms here, Pelham, in relation to my interest charges I am unsure exactly what they are at the moment, hence the S.A.R - (Subject Access Request), once I have all the documentation I can study them and see what they are, unfortunately having moved since taking out the loan the agreement has been mislaid but have the boss searching for it. As for me stating the extortionate rates, I think everyone where Welcome is concerned would agree with me regardless of what my monthly/anual APR was, we went to Welcome for possibly the same reasons others do, in the past we had some financial problems and was looking at refinancing and clearing the whole lot once we had remortgaged, it took some time for us to sort everything but are now back on track. We, like others who had the misfortune of approaching welcome, did so as a last resort.

I'm sure you can, send them a CCA +£1 and go through your acount, see how many times they have penalised you then go claim the excessive charges back, cant wait for mine to turn up although mine was a personal loan.

I agree they really are the pits and they have the audacity to send you AND your wife identical letters and charge you for both? That is really taking the P*** ( as they always do) do they think that all their clients are stupid and wont pick up on things like that? It just shows what lengths these people will go to in order to squeeze more out of you.

In relation to the S.A.R - (Subject Access Request) I actually took mine personally into the local branch and gave it to the branch manager, she said that she would send it on to head office, if you do that with the £10 cheque they will forward it on for you. If they dont thats their tough luck they got 40 days ;-)

we were with them for a few years and the only letters we got were for us to contact them, they stated that they had tried contacting us by phone but never got any answer, thats bull as we have a voicemail system on our phone, they never sent us statements either. I'm looking forward to what they do send in reply to my SARN it could be very interesting reading and almost certainly financially beneficial to us! ;-)

I belive they are nbot allowed to call at your door unless by prior arrangement with you. I had them knocking on my door too until I told him that I would report him for harrassment and if he didnt leave my property I was well within my legal rights to escort him from my door using minimum ammount of force necessary obviously :-D Needless to say, he left prety quick and they stopped knocking especially after I rang the Branch manager and told her he was trespassing;-)

is the car on credit with Welcome and was the SAR in relation to that loan account or a personal one? I cant see it having any bearing on either to be honest, at the end of the day your looking for their faults to be rectified and get back whats rightfully yours. ;-)
