Once you start your claim it would probably be a good idea to start your own thread, that way you can use it as your journal where you can post your progress, questions and any problems you may incure along the way. It also makes it a lot easier to interact with other CAG members and you'll find it a lot easier to keep tabs on your position with regards to your claim.

Hows this for a bit of confusion, I got home from work this evening to find another AQ in the post, I really don't understand this. My claim was filed with MCOL and once Cobbetts returned their defence my case was transferred to Bristol County Court. I was notified of this by Northampton Bulk centre along with my first AQ form, which was due to be returned to Bristol CC by 22nd November. I have completed this AQ and returned to the court via recorded delivery and it was delivered on Fri 10th, now I've received a second copy from Bristol CC stating it must be returned by 30th Nov. Firstly do I need to fill out the form again? Secondly does this now mean Cobbetts will have an extra 8 days to return their AQ?

 

Its probably confusion on the courts part, after all they are a little snowed under at the moment, but I don't really want to be giving Cobbetts another 8 days, they've had long enough to pay up as it is.

 

Has anything like this happened to anyone else? What should I do?.......if anything?

 

 

Just phoned Bristol County Court to try and sort out the mix up of receiving a second AQ, was told that my first one was received on 10th and that I should just ignore the second one.

 

I queried the dates, as one was due back 22nd and the second due back 30th, and was told that because they were a bigger court they allowed a longer period.....that really makes sense....not!! You'd think a bigger court would be more efficient!!

The dates I was referring to were the deadlines for returning the AQ form.

Just checked my bank online and the AQ cheque has been cashed, so that's another 100 quid going on my claim!!

To be perfectly honest I'm not really expecting a cheque anytime soon, all I do know is that up until now most of the correspondance I have received in relation to my claim has usually been delivered on a Saturday...so who knows, something tommorrow perhaps!!

Got home to find that I'd missed a special delivery in the post!!

 

Quickly dashed up the Post Office anticipating a cheque from Cobbetts only to find it was my SAR from Capital One. Ah well, something to keep me occupied in the mean time I suppose. Had a quick look through and seems I've got approx £600 of charges to try and claim back. Not too sure about what interest I can claim on a credit card though, if any, or whether or not the 8% comes into effect on credit cards. Better have a good read through credit cards section and get this claim on the move too!

Whatwas the deadline for AQ?

 

Well there does seem to be a little confusion on that part, as I detailed in a earlier post I originally received my Alocation Questionaire along with my Notice Of Transfer Of Proceedings, on top of this form it was stated that it should be returned to Bristol County Court by 22nd November. I completed this fairly quickly hoping that it would give Cobbetts a push into returning theirs. Several days later I received another AQ from Bristol CC stating that it should be returned by 30th Nov. Major confusion!!

I did phone the court to ask them to clear this up but the lady I spoke to seemed a little confused herself by the matter, she told me that because Bristol was a bigger court they allowed more time for the AQ to be returned. I find this rather strange, as surely a bigger court should be more efficient!!

 

Not sure whether Cobbetts received two AQ's and therefore don't really know which date they'll be working to, should I perhaps phone Cobbetts and querie this??

Phoned Bristol CC to see if Cobbetts had returned their AQ yet, but no such luck. I guess they're really gonna string this out til the bitter end and really make me wait!:-|

 

Asked the rather helpful lady what Cobbetts deadline was for returning their AQ as there had been some slight confusion with fact that I had received two copies and two different deadlines, she confirmed that it was 30th Nov ( had to be expected I guess).

 

Don't suppose I'll be hearing anything before then, unless I give Cobbetts some hassle on the phone (maybe my mission for tomorrow), to try and get some positive action!!

You could but they will just say wait for the AQ to be filed- no point stressing yourself just yet - although I have to say the lady that I speak to there is very nice. Ann-Marie if you want a name.

 

Well decided to phone Cobbetts in the end and spoke to Ann-Marie, (she is very nice, thanks Giz). She said that they had not returned their AQ as of yet but she wasn't able to clarify as to when it would happen.

 

The wait goes on!!!

I've been waiting forever - only had £74 back and paid out near on £900 in court fees!

 

You certainly are a little bit out of pocket hey Giz.

 

I hope my cheque isn't too far away Scarlet, I've got moths coming out my wallet!!

Well looks like I've now got more problems, I set up my parachute account before I started my claim against Nat West and everything seemed to be in place with regards to my Standing Orders and Direct Debits, until today anyway. My Nat West Loan payment was due out yesterday but for some reason hasn't left either of my accounts even though my loan account shows it as being paid. I phoned Halifax who told me the DD was active but no request for payment had been made. I then phoned Nat West to be told that my loan payment could only be taken from A Nat West account. This is going to be rather difficult as I have transfered all my payments from this account to Halifax and my NW account has no funds in it.

 

Can they insist on this? and does this mean I'm going to be unable to close my Nat West account??

I changed accounts in the summer to HSBC - and the ytold me the same after a very loud argument in the branch they agreed that it was not in T&C anywhere just their preferredf method of payment - I said my preferred method was to cut all ties with Nat West - queue got longer and longer I got louder and louder you get the picture? I cancelled DD on line wrote nad told them under no circumstances was it to be reactivated and my now famous loan gets paid by standing order from my new HSBC account.

 

Looks like I've got my own verbal hockey match coming up Sat morning then........Nat West staff be warned!!

Trouble is Nat West don't seem to have a sense of humour - or cobbetts for that matter!

 

Don't suppose any of their staff will be going to the Xmas panto then!!

A freind of mine used to work for NatWest and got a reduced rate mortgage - anyway she borrowed more to extend house and realised about a year later thatshe was overpaying - after a few bacardis on a friday night we drafted letter to chief executives office asking for refund and compensation - she got it £600 and compo of £200 and a promotion to manager for observation and initiative! Got amde redundant about 4 years later with a hughe payout as well. That was after we went to a posh xmas party and had more bacardi:D

 

Well sounds like you've got something out of Nat West, even if it was only a few bacardis.
