    • I live in a student house, with 5 tenants, unihomes is our utilities provider, who we each have a direct debit set up with and have paid each bill every month. Two letters were sent in my name by BWLegal saying I had two outstanding payments due adding up to over £3500, I have tried to contact british gas (as that is apparently our houses provider) as well as Unihomes. Nothing has helped and BWlegal are pursuing legal action if these debts are not resolved by the 1st May. What do I do? I've called Bwlegal when i bring up that the debt isnt for me and for unihomes they hang up on me. so I am stressed and do not know what to do

    • Hi, everyone. I received a letter from TfL investigator/Prosecutor. The letter reads as follow:   ''Thank you for responding to our enquiry letter. Your comments will be taken into consideration when reviewing whis case and we will contact you as soon as we have reached a decision. TfL now consider prosecution against passengers who are in breach of all TfL byelaw offences and I must inform you that further legal action may be taken. TfL byelaws can be found at ... Please do not hesitate to contact me if I can assist you further.''   The letter was sent 23 days after I replied to them. Should I send another begging letter to IAP? I'm extremely scared now. Thanks all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I'll try and make this short, sweet and to the point.

 

In 2007 I went a few pence overdrawn with the nationwide.

this amount grew with £30 charges being added every month.

 

I spoke with Nationwide and came to an agreement to pay xx amount monthly, which I honoured.

 

I then receive a letter from a debt collection company stating that I owe £154 (this included their charges).

 

I phoned Nationwide and obviously wondered why this had been passed to a debt collectors when I was paying this monthly.

 

Nationwide said that is was because I didn;t pay the interest associated with the debt/charges

which i disagreed with as this had not been pointed out to me when I had made these monthy arrangments.

 

They dismissd that claim and stated that it would had been discussed.

 

So they slap a default on my credit file, I pay the £154 to the debt collectors (through gritted teeth) and the default has been classed as satisfied on my credit file.

 

My question is do i have a case to get this satisfied defaut removed from my file and how would I go about doing this.

Pm brig. Im pretty sure, although not 100% that if the cause of default was the banks charges, then the default shouldnt have been recorded in the first place.

I think it's part of the ICO's guidance. I'm sure someone can jump in to confirm it tho.

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

or

convert existing PC files to PDF [office has an installable print to PDF option]

Can i ask if you made any payments to the debt, or acknowledged it in writing between the start date and default? It's probably nothing, but im just curious why it was entered and then satisfied on the same date. Unless a lowlife DCA took it over and added it.

Hmm. If theyve passed it on while you have been paying, then something smells fishy. Since the entire debt is pretty much unfair charges, then we have our answer. Time to get reclaiming and wipe that debt out.

Nationwide said they passed it to a dca because I didn't pay the interest on the charges.

I'm not too bothered bout reclaaiming the bank charges as I know there was a case a few years back to stop people reclaming them and the bank won? I just want the default removed as I beleve its unfair as I was paying the charges back

THose charges were unfair and caused the account to default.

 

You need good and concrete proof to get the default removed, and if your info is right, then you have it. However, you should still see about reclaiming those charges/fees as the bank as pretty much admitted they are unfair. If they really thought they were enforceable, they wouldnt have sold the debt to a lowlife DCA.

no it was unfair because the default SUM included PENALTY charges

 

The Information Commissioners Office guidance states.

That if a default sum is made up of charges that without such

charges a default would not have been placed

then NO default should be placed.

I have lookd for a default notice and can;t seem to find one, it may have been throw out as it was 3 years ago.

 

How do I go about resolving this?
