    • Thanks dx for your guide. Yes, I will use their services, but not often. I usually spend around 80 per month, but the season ticket price is 160. I plan to renew it as long it could help me to show that I will not do it again.

I notice that you are asking for proportionality at the same time as you are demanding  an unlawful £160 when you are aware that under PoFA the maximum that can be demanded  is only £100. You will note  that I have included the Solicitor's Regulation Authority into our conversation in order to ensure your reply. And your old excuse of "admin. error" is surely wearing a bit thin even with the SRA. so I look forward to an apology for your error and a declaration that you will desist from trying to hoodwink other motorists in future.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I Have to say if there is anyone i really want to get my money back off its BOS they charges have infuriated me since day one and really wish i never got the card in the 1st place, snet my s.a.r off today

 

any comments on how good they are at getting them sent out mould be much appreciated

Hi Guys thanks for the replies, barclays sent me my statements straight away after trying to charge me £200+ (£3 per statement), but your right they did duplicate some of them but its really BOS that i'm gunning for, they have [edit] me and caused both me and my husbands huge amounts of stress over the last 8yrs ive had the account, so cant wait to get the statements to see how much i can claim back,

Hi Mairi, i wont be taking anything from BOS except the full amount, so they can send as many offers and goodwills as they like, bring it on thats what i say, how long does it take for them to come through with the first offer do you think

i wonder if you could help me,

 

ive got a claim against bos and they made an offer over the phone of £1400 which i accepted, but that was back in january since then i have heard nothing...

 

ive tried calling but cant get through to the right people. does anyone have the correct numbers for BOS

well, got a letter from bank of scotland this morning offering me £550 of a £1400 claim, saying this runs inline with there policy and it was half of what i was after, someone there end is crap at maths i'm guessing, it wont come as a suprise i turned the offer down

hello all, havent been on here for a while as ive also been doing a claim with lloyds tsb and wanted to get that sorted before i went for bos.

 

i'm claiming £2000 back, are they any easier to deal with than lloyds as they really know how to drag it out.

has oneone got any pointers for me

god i didnt realise, lets hope my judge is having a good day then if and when it gets there. i cant believe cc companies are asking for a stay when it doesnt involve them. looks like this may drag a little longer than lloyds
