      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On the plus side it's meant to end before Christmas, so we'll save a packet on pressies and postage for cards this year :)

I'd like to be part of the 3 holidays a year crew!!! I'm pretty sure I could handle that and still be a normal nice person (just with a wicked tan:))

I would imagine they're not all like that (well I'd like to hope not)! I have two friends who are the absolute opposite of each other when it comes to being well off - one bless her really doesn't have much at all, but whatever she has, if you need it, you can have it! And my other friends, is what we'd call rolling in it :lol: she's not in the least as I described, and has in fact only just come back from her first holiday in years - she'll also help anyone if they need it!

 

But someone else I know, I remember there being a discussion about how the government were causing people to live on the breadline, and were genuinely struggling to feed their family - when this one piped up ( and was being utterly serious ) "oh well it looks like I'm going to have to sell my other car" :pound:

 

The other car was what you'd call a "Sunday" car, with a private number plate - oh the hardship :lol:

 

:lol: I know just what you mean. When we were in real dire straights a few years ago we were at our (well off) friends' house talking about how we'd had to raid the penny jar to buy milk that week etc - just having a bit of a moan really. They sympathised saying they were in real trouble at the moment as well, then almost in the same breath listed off the two skiing holidays (one for each of them as they just need to get away sometimes), week in Spain (although it was a hol with parents so that doesn't really count) and the 6 week US trip they were about to undertake in a few months. Very sadly indeed they'd had to curtail plans for a winter-sun holiday to perk them up as it would mean they didn't have the funds to spend in the US. I really felt for them then :rolleyes:

It doesn't help that all of the party leaders are simply incapable of knowing what it is like to be ordinary. Three chaps of varying degrees of poshness who have never done a proper days work between then. People who have only ever done political research jobs, worked as translators in the EU or just been professional Councillors before should never be allowed to enter parliament.

I think this is the crux of it exactly, they have no idea what 'normal' people live like. I watched a pm's question time at my dads a few weeks ago - never normally do as it makes me so mad, and this was no exception.

 

They were talking about the TC cuts and a lady asked (paraphrasing here as it was a few weeks ago!)Cameron how he would justify the cuts to the people who routinely have to put things back at the checkout as they realise they can't afford a whole shop that week. He referred to it as a ridiculous question and wouldn't even answer.

 

I'd guess there's not many of us on these boards who haven't been in that situation, so to insinuate that it is a ridiculous concept that anyone wouldn't be able to buy a full shop I think shows how far in Lala Land that man lives.
