    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

I had my ATOS Medicial on 17/2/12 and it was all in favour of the doctor??? and his computer. I had no chance to state my case and illness. It was very unfair. He kept saying you are fine. I kept trying to give him the facts. Had even typed up a report on myself and my medicial history. He did not even look at it. Should wait for letter and see! I think I may goto Tribunal in the long term. Quite happy to wait for tribunal, if that is what it takes and take no money and live on savings while waiting. Cannot face going to Job Centre. I have depression etc. Good luck to you all.

Don't leave, this is EXACTLY what happens all the time, please fight it! Make sure you read everything here, and DO PLEASE APPEAL and go to Tribunal, this is what should get you through to a full ESA claim.

 

If you ask for review now, you will get your ESA reinstated at the assessment rate, and take it to appeal with the advice and help of the more knowledgeable people here. Hang on in there!

If you are claiming ESA, and you fail the ATOS medical, you can be paid while you are waiting for the tribunal to hear your appeal - you don't need to live off your savings.

If you are claiming ESA, and you fail the ATOS medical, you can be paid while you are waiting for the tribunal to hear your appeal - you don't need to live off your savings.

 

Do you know how to go about getting that done? And do they HAVE to pay you whilst appealing?

Yes, they have to pay you if, and only if:

 

  • You attended a medical and failed on points
  • You have submitted a valid appeal on form GL24 or via a signed letter that clearly states it's an appeal
  • and you continue to submit sick notes

 

It can take a week or two for your payments to restart, but it should happen automatically. This applies to ESA only - other benefits may differ.

  • You attended a medical and failed on points
  • You have submitted a valid appeal on form GL24 or via a signed letter that clearly states it's an appeal
  • and you continue to submit sick notes

 

 

It can take a week or two for your payments to restart, but it should happen automatically. This applies to ESA only - other benefits may differ.

 

 

Had my medical and surprise I got no points so appealed and am now waiting for the Decision Maker.

 

Since sending in appeal and sick note, I got a letter on the 7th Feb, telling me they had received my appeal and it was now being sent to the Decision Maker.

 

I've decided to give it until after this weekend to see if my ESA starts up again.

 

Can't remember how long it took the last time I appealed. They must think you can live on fresh air.:-x

Your ESA should continue without a break, if they've received your Appeal form.

 

You should be paid at the Assessment Rate while appealing.

Not had an ESA payment since the 24th of Jan.

 

I know it will be back dated, but you still have to live in the meanwhile.

Thanks Antone. I just hope they hurry it up as i have no other source of income.

Can anyone help. I have been getting incapacity have failed atos medical am now appealing this decision. What benefit will I receive during this period?.thanks.

You ask DWP to pay you at the assessment rate of ESA £67.50 per week, you will need to send in fit notes whilst awaiting your appeal. Hope this helps, and good luck.

Im wondering if anyone can help me as i dont know how to make my own thread,

 

I made a claim for ESA In november but only had my medical on the 9th july 2012, if i pass my medical will i get my money (the extra money you get from 13 weeks) back dated?
