    • Thanks just looked at SARequest It wouldn’t make ebay have to say why they suspended me. all their email said was that it was related to buying activity. But under that bike buying activity there are about five different reasons why it could’ve been. But they haven’t specified which of these five reasons it was.
    • Thank you Ethel, their letter was literally one line, with an added bonus of a typo..... "As you own the land that the property was damaged on we would not be able to dela with that aspect of the claim.", so I think it may be the initial fob off. I have replied just stating "This is not correct, the fence is owned by XYZ ltd, please clarify?", but will follow it up with a letter from the company. will let you know how I get on x
    • About a year ago i was summonsed to court for a speeding offence, long story short it wasn't me that was driving the vehicle, and i successfully proved that i had not received any paperwork (the reason it went to a summons) because there is a problem with our address, i live at number 7, yet when you look online to enter our address for anything you have 7, 5-7 and 7-9 on our street, one is my address and two are businesses.  The court ruled that there was an issue, and agreed i did not receive any paperwork (aside from me not being the driver)  i thought it odd that i never received anything in the post to say that, but they are the courts i assumed everything would be in order. Now just recently i have been using family members vehicles to get to work and have been insuring the vehicles on a temporary basis. Recently when using a comparison website i would get results and then when i went to make payment it would not let me advance, i had tried this on numerous sites and the same happened, i assumed that it would have been because i have used to many temporary insurances and it may have flagged for whatever reason. i went to check my license online, and i cant view it, it states below, i called the DVLA and they can not view any details either and have said they will need to raise a case internally to find out what has happened.  My wife and brother seem to think that the courts have screwed up not informed the DVLA of anything, hence i was banned. But surely it wouldn't have taken so long for me to stop being able to insure my vehicle on a temporary basis until just now?? Please can anyone assist as im worried sick now and ive done absolutely nothing wrong, i need my license for my job. .................... It has not been possible to display/match your driving licence. • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Were they as seriously messed up as mine?

Just read and had to reply. I was in similar predicament 3 years ago they asked to investigate as, like u i had not been taking into account pay grade increases. I ended up being overpaid around £8000 over a 4 year period as unfortuntely they will go over a few years. I found honesty the best and wrote a letter explaining the circumstanses. They were actually ok as long as u r honest, outcome being i havent been paid for the past 3 years as they have been collecting the money as overpayment. this is standard.

Speaking as a psych nurse the doctor is most certainly priority. Reading all your posts it would seem you have other issues and the tax credits has been the last straw? If you are having thoughts to harm yourself you can also go to your local a&e for help as many areas have an outreach team that work from a&e. You are not alone and once you have help they will also be able to help advocate between you and the tax credit office but your priority must be yourself first

Unfortunately it sounds like your gp missed the point as many do! If you do not feel he/she gave you proper advise please do take yourself to a&e and ask for the mental health team they really can help. Also you can contact mind.co.uk who can offer brill advice and reassurance. I dont think you are in any state to be handling tax credits alone and an advocate can act on your behalf. Again mind can offer advice on local advocacy services

Hello again Sososcared,

Take a deep breath and start again. From my understanding your award has been "selected for review" as they have information from your 2011 award that is different from the income you declared? I understand that you are worried that you now realise the last 3 years has been incorrect, but that the HMRC has not yet asked about these 3 years. As ErikaPNP rightly pointed out you only have to declare what has been requested, but they are giving you an opportunity to put things right - they know what your actual income was, and will know for the last 3 years as I found out when my award was selected for review as they receive the info direct from employers at the end of the tax year - it is only when they chose to investigate a claim that they look back to check their figures. As they have only asked about 2011 you only have to answer to 2011, HOWEVER they will look back once a case has been opened and if you choose not to volunteer info now they may enforce harsher penalties.

As I have stated before, I really do not think you are in the right frame of mind to be dealing with this alone and an advocate will be able to deal with the HMRC on your behalf. From your original posting you said that you were given until 20th Jan to respond - that gives you 1 day to at least contact them via the phone and let them know that you are seeking an advocate; this will count as contact and they will give you more time. If you do nothing and do not contact them the problem will not go away and will only make your mental health more fragile with worry.

You said previously that you "have gone through everything and made a list of my working out to show them how I came to the figures I did. Its amazing the amount of paperwork I had around the house, P60s everywhere - old handbags, carrier bag lodged in the back of a cupboard etc. Think its time to seriously sort this out and get a file or something. I just put stuff somewhere thinking, 'I'll do that at the weekend/next week - and never get to it". It does not seem that you have done anything with the info, you MUST PHONE THEM TODAY and let them know you need more time to find yourself an advocate. After that phone call, please contact Mind if you have not done so already and you will be glad that you did.
