    • retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free  I hope dpd will refund them so they don't lose out. Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx  
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ahh, another beauty student....the amount of times i was wrestled to the ground by my girlfriend so she could practice applying make up on me. (shudder)

Good luck with it. I don't suppose you'll be qaulified to do shoulder massages after this will you. You see i got a real stiff neck from the amount of time I've been sat in front of the computer doing my research for this claim.........maybe I could add that to the costs incurred in my claim...uhhmmm.

Copy of Clysdale's .oO( Their spelling not mine :confused: ) AQ received this morning. They ticked Yes on section A! Erm they've had 6 months to settle this and they have the cheek to ask for a further month?. Section D - Witnesses... 2 (In total) I'm assuming that Bill & Ben are getting some great wages at the moment. Section F - Hearing... No (none that the bank are aware of at the moment). Signed by Kirstie Ann Ross and dated 5/2/07 even though it should read 5/3/07. Oh and there's a typo on the court name haha :rolleyes: Time to sit and wait yet again.

Hi sarah,

I notice you are at the same stage as me, I have just checked through their AQ again, I noticed it wasn't signed or dated and the covering letter telling me that they had ' today' filed their AQ in court was dated 5th March.. the Aq had to be filed by 4th March.. I'm hoping they have cocked up in my favour but as usual they will probably get away with it ( as 4th was a Sunday)

Clydesdale/Yokshire Bank are 1 of the hardest banks to claim against. I don't think I've read 1 thread on here where somebody has managed to get their charges back within 6 - 8 weeks. I wish they would pay up that quick as it would have saved people so much time and effort :mad:

It depends very much on the bank, and solicitors would not get money any quicker off YB in my opinion. It can take well under a month against smile. Why let a solicitor, who probably has less need of it than most of us, have a share of our money if you can get it all for yourself. A solicitor isn't likely to do anything different to CAG users in my opinion, and the chances are that a lot of people on CAG have more experience claiming back charges than solicitors.

 

Have you noticed they didn't suggest doing it until the public started claiming and they saw the chance of a quick buck. There may be occasions when their professional advice is needed, but most claims against banks can be made independently in my opinion.

Has anyone got the current telephone number for the lovely Kirstie Ross? :rolleyes: In their AQ they stated that they required a month to try and settle and that month is well and truly up now. I think it might be worth giving her a call and asking why I've not heard anything regarding a settlement yet.

Just a quick update... Well nothing to report really as I've heard nothing from anyone at YB :mad: I've spent loads of time reading up on the court bundle and think I've got to grips with it all at last. Got a family funeral to attend in Devon over the next few days so will start preparing court bundle to print off next week. I'll be sending the lovely Kirstie Ross a copy and maybe she'll realise that I have no intention of backing down over this!. Court date is just over 6 weeks away and YB have never made any effort to settle this claim in the 7 months that it's been going on. I'm glad that I have the support of so many great people on this site. If I didn't have that support I think I would have given up by now. Just a quick message for anyone that is starting on this journey...

 

DON'T EVER GIVE UP!!!!!

Sarah, I think you and i have fallen down the back of Kirsty Ross's filing cabinet, I sent them my court bundle 2 months ago and i haven't had there's. Indeed i haven't heard from them for a small e-on, Perhaps they think if they put their heads in the sand and ignore us we'll go away:rolleyes:

Moss you are a complete newby. You didn't even join CAG until November, and you expect YB to pay up within 6 months. Took me 10 months so why should you get special treatment!

Hi Caro, I think you and the other pioneers got the special treatment :p i was hoping for more ordinary treatment, but however long YB drag it out it won't change the outcome. hope it's not another 4 months though

Hi there,

don't get too dis-spirited now. YB settled my claim 2 days before they were ordered to disclose documents to me. I started my claim in November , so it's been 5 months from beginning to end. I know I have been lucky, but I think the judge helped with the order.

Hopefully won't be too long for you, stay 8) x

I'm cool :) No really it takes as long as it takes and the more obstacles they put in my way the taller i become. Actually i think i might miss it when it's over.
