      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As a (recently given up) gambling addict I got into the big trap of Payday loans!

 

Here is my current list of shame!

 

Wonga : £1085 loan, £1413.17 owed Monday 18 July (can be extended 3 more times by paying off the interest each time)

 

Tooth Fairy Finance : £400 loan, £544 owed Thursday 28 July

 

Payday Express : £400 loan taken out Thursday 5 May, just been extending this month after month paying off the £100 interest each time. Next due date is likely Tuesday 26 July

 

QuickQuid : £400 loan taken out Thursday 30 June, £50 due on Friday 29 July (discount code used here) then £500 due on Friday 26 August (can be extended 3/4 times again by paying off interest)

 

Speedy Cash : £150 loan taken out yesterday (!!) and just under £200 owed Tuesday 26 July, so much for 'speedy' I took this out because my bank account went into unauthorized overdraft and wanted to avoid the £25 + £25 + £25 etc snowball fee. Cheeky buggers even charged a fiver for the 'speedy cash transfer' which isn't there yet!

 

Just looking for any tips on what to do next? My monthly take home pay is around £1400 but I may not be earning as much income during the months of August and September. Wonga are my largest concern.

 

I have tried for some loans but getting turned down, probably because I have £2750 in credit card funds almost maxed out (Although, interest free until 2012) and £1500 overdraft with HSBC spread over 2 accounts, plus a £2500 loan with them however I have been keeping up my payments with this and have 3 left to go (July, August, September).

 

Don't know if anyone has heard of a company called 'Everyday Loans' but I applied for a £3000 loan with them recently as despite the huge APR it would have been better to have a small monthly payment and clear all the payday loans which they accepted me for then as soon as I got to their office they took one look at the payday mess and turned me down despite me telling them that was what I intended to use the loan for over the telephone! :mad2:

Its time for you to take the plunge, be brave and retake control.

 

You need to default with all of these, some rides will be smooth some will be rough. You need to move your wages to another account, and cancel all debit cards, as even with an agreed plan, they will try to plunder.

 

Email errol.damelin@wonga.com and balanceoffer@wonga.com and john.hegarty@wonga.com.

wonga at these 3 email addresses advise your financial circumstances have changed and you propose a 12mth repayment plan, you require all interest and charges to be stopped, and require sort code/acc number and reference number so you can make a payment each month. do this now as wonga will stop the interest from the point you contact them

 

UNfortunately the other companies wont do this, but will do it from your next due date.

 

PDE wont budge, you may need to ride this one out til it goes to a DCA, also the same with QuickQuid,. they may be happy with 3mth plan, but no more.

 

Not sure about the others, keep us updated, come back for more help if needed.

I have just finished a 6mth plan with 10 companies.....

If I can get a 12 month plan with Wonga that would be ideal, that would mean the others I could just about manage to clear even if I have to roll a couple forward a few more times.

 

No you need to default on the rest as well and stop paying interest. this will help you in the longer run. I assume like most of us here, your credit is shot to pieces!!

Default on all, and keep emailling everyone that refuses, email them everyday, this continues to show your willingness to pay debt, but only at a rate that you can afford, and still be able to live your life.

 

the golden rule here is loan +1mths interest... no more, and no charges (the chartges they charge are unfair, and could be challenged in court, and not many PDL like this route, as they then need to explain their fees, and their naughty unlawful thefts from bank accounts)

Got a mail back from Tarik Abdellah already, they say a 12 month plan has been put in place with immediate effect and the first installment will be taken on the 18th July, interest frozen.

 

I'll give them respect for that, they may charge a lot but I've always been fair with them until now and they've been fair to me now without any hassle!

did you get their bank details?? you need to make this payments yourself, faster payment preferably, either by phone/or internet banking.

Cancel that card as well....

PDL's including Wonga have been known to agree, and if debit card details are available then known to raid the account at will.

They said it would be taken from my debit card, I am ensuring only the exact amount is in my bank account (can't go overdrawn with my account). I logged in to My Account page and the repayment plan page is showing up.

 

With regards to Payday Express and how hard they are to budge, since I've rolled over the loan twice so far would it be worth rolling it over 3 more times then telling them to go away since I've paid the original amount plus 1 month interest? In effect a £100 monthly repayment plan which I can afford.

Make sure your income is protected otherwise it will all be taken....

 

You have been given good advice so far, try to be reasonable with them first. Don't make threats that you won't carry through.

 

If they step out of line complain to the OFT and Trading Standards.

you need to cancel this card...... SERIOUSLY...... you might have the money there for wonga, but one of the other PDL's will nab it, Wonga will get ****ed, and hit you with all sorts....

 

This is why you MUST CANCEL your cards to protect the repayment plans, or you will BE BACK to square 1.

EMail them again, ask for their details, and advise in the email you need these to protect your repayment plans.
