      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

(may I firstly apologise if my current situation has already been discussed...)

 

Ok, I currently have about £800 to repay on my next pay day across Wonga, PaydayUK and Payday Express as well as three credit cards (capital one, vanquis and aqua) and a couple of other loans.

 

The issue I have, that since the 1st pay day loan that I took out in January, all I have done since is struggle on my normal pay, without taking another pay day loan out the following month. I really do not want to be in this situation any longer. I'd be really happy if I could find a way to consolidate these three payday loans, or find some way around this (I really do not mind how long it takes). I'm afraid no loan company is likely to touch me due to the sheer number of unsecured loans that I currently have.

 

Does anybody have any suggestions?

Welcome, and well done for trying to take control. It starts here.

 

Cancel your bank cards, and open a new easycash account with the halifax......

(if you dont they WILL STEAL money at will, at all hours, and for all amounts)

 

send the same email (straightaway, as they WILL freeze interest) to these 3 addresses at Wonga:

errol.damelin@wonga.com and balanceoffer@wonga.com and john.hegarty@wonga.com.

 

explain you financial circumstances have changed, and you propose to pay your balance Xamount of months. they are normally very quick to respond.... also ask for sort code/acc number so you can make faster payments on you payday. Ring PDUK one day after payday, as they onwt do anything today, explain to them they will agree to aa 3mth plan, then to review 3mths later, i extended another 3mths to clear.....

 

Payday express..... these people wont listen to you, their bank details are like golddust. you will need to ride this one out..... email them every day, keep copies, and whatever you propose to pay, keep it to one side, so when they do you can get rid of these sharks as quick as..... i defaulted on 10loans in february, and pay the last 4 off on friday, and then i will be PAYDAY LOAN FREE!

And secondly, is this a fairly normal way to deal with this sort of situation? It just genuinely scares me, is all.....

Yes... you cancel cards nows.... read these forums, and you ill read people who even came to repayment plans still had their accounts plundered.

Do no apply for more as some share your barnk details, and could get the new one that way.

They dont tell you that they do this.

If you can appply for a new current account, do so, but do this now.......

The santander instant plus account is also good and you have a visa debit card with it. Just a basic account but I find it is great.

Report your card as stolen, then it will be blocked. If you want to consolidate and not get further into debt you would be better off going to C.A.B or look up a company like "Payplan" on the internet. They are a non profit organization who will set up a debt management plan for you. They will write to your creditors, explain your situation and make offers of monthly repayments. You will then pay one amount each month which you can afford and they will distribute it to your creditors. You will then be in control of your money. Do NOT give any of the creditors your new card details or bank details, they will take whatever they can.
