      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a account with littlewood's that is in collection's with NDR Money. Following post's on here i decided to request my CCA. They replyed in a timely manner but with a reconstitued copy of my credit agreement. just printed info, no signature's. I then sent a second letter informing them that they had not sent what i had asked for and that the account is now in default and they had 30day's to respond to my request, also asking for a copy of thier internal complaint's proceduer.

 

They have since responded with the same document's stating that they sent this in the first letter and have included any amendment's made to the T&C's. What is my next step as NDR money are asking for the full amount as well as putting charge's on each time i dont pay and each time they send a letter. I did not realise till today that i could claim these back and i have throw the statment's away (stupid i know)

 

Please help??????

 

Also just a little bit of hope for those stuggling with Quick Quid!

 

I have a Quick Quid load that is currently in default i have recived my second notice requesting payment. It is approximatly sitting at around £550 pound outstanding. Just not sure were to start with this one either! I have called to offer a payment paln but they a re not happy with accepting this and olny want to take the full amount? I have since contacted the by email and requested a payment plan which they have accomodated, they sent me two option's the second of which i have agreed to on the condition that they amend the payment date's as they are not suitable currently waiting for a response!!

Hi All,

 

Just to update you, i have had a reply from Quick quid this mornig who have said that, Due to the Histroy of the account, my payments have been schedualed on the contracltual pay date (which have changed as im now paid weekly!!) Also my account is 60 days past due a payment ( i made a token payment of £100 on the 27th May). Then they have just follwoed with the useal please pay to avoid 3rd party involvement! The plan they are offer is

 

£156.08 - 30/06/2011

£156.08 - 29/07/2011

£156.08 - 31/08/2011

 

I asked them to consider this plan which they have refused

 

£156.08 - 01/07/2011

£156.08 - 05/08/2011

£156.08 - 02/09/2011

!

 

 

I have penned the following email in response " One gain thank you for your reply. But as staed in my previous email i would not be able to commit to the date's of which you have suggested. The payment plan i have proposed is only delayed by one week. If as you have mentioned you are taking note of my situation then you would have indeed excepted the offer i have made

 

I have all ready agreed to re-pay over three payments which will be difficult enough. What i am asking is not unreasonalbe. I'm sure any court or Judge would accept these payments rather than nothing.

 

Please advise guy's i really need to know were to go with this. I also still need help on the NDR money as i am now as mention in th first post, they can onlr produce a reconstitued copy of my CCA.

It is strange that they are rejecting your offer of repayment because of the payment dates.

Is there anyway you can send them proof that your paydate has now changed if this will help things?

I am a tempory worker so if i have no work from one week till the next i dont get paid! At the moment i am just trying to offer them what i know i can do. It's a differnce of one week!!

 

The option they are giving mean's i have one week basicly to find £156/08 from my wages. Which means another bill will have to be left. I am just starting to get back on my feet after redundancy and no work for a year. Why are they all so unreasonable :(

email quickquid again offering what you have stated and keep emailing them ad let them know thats the best there going to get, if you go on quickquid how to contact us page you will reaf resolutions@quickquid (something along them lines) and send a email to them you wil get response starightaway. X

 

with the cca, explain to them it does not have your signature nor have you sighned it,, and see what happens. Im sorry i can only help this much with the cca. X

Thanks for your help. I have now arranged a more suitable payment term's with Quick quid and am now starting to clear the debt..

 

I still need advice on the NDR/Littlewoods account. As mentioned before they have sent me two Re-constituted copies of my credit agreement but no copy of any origonal with a signature? What is my next move. Please respond as i need to address this one urgently. NDR keep calling........

Hi, Guy's i still really need some help with this issue!! They are calling at least three time's a day now. and late in to the night.

 

Please advise where i can go from here as i said in previous post's.....

 

All they have sent me is a re-constituted copy of my CCA. what do i do know?

 

Please help. Really dont know what to do, scared to answer the phone as they call from differnt numbers. Just scared the next thing will be court and balif's at my door.

 

Please can someone offer some advice i have been postiing since last week!!! :(

Hi Confused, quick question, are NDR a DCA? Assuming they are, you may want to start a thread in the DCA section of the forum and post up your re-constituted copy of the CCA and ask someone there to have a look? Just a thought.
