    • wont go near it with a barge pole as its ex gov't debt.
    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, my name is Ademola.

I am 16 and I am a Victim of Online Fraud. After mistakenly filling in details for an phishing hack, I have now become liable to pay of an £8000 debt and I have currently appealed. Please, I am desperate as I do not currently have a Job and have no way of paying this back and I need help. I would also like to know what the beneficiary bank would be able to offer me. Thank you.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Report this to the Police in the first instance, everything else will follow from there.

If you can give a bit more info, who is saying you owe this money? The bank?

How do they say they paid this, was it direct to you, what was the fraud?

The fraud team that I spoke to said that my personal information had been compromised and they had to decided whether or not to wipe the slate clean or make me pay for it.

What actually happened was that I stupidly filled out a phishing [problem] claiming to be from the bank and because of that, the fraudsters were able to access my account. What really confused me was that they were able to put a "online cheque" into my account according to the bank statements I received that exact month, and they were transferring a specific amount of money into my account all in one day before the cheque bounced.

Let the bank conduct it's investigation, although I would ask them if they have informed the Police, if not you should do so.

IF they won't/don't or can't wipe this fraudulent debt then that will be the time to escalate your complaint to the FOS.

Hi Noble,

Sorry to hear of your problem! This seems to be becoming the latest phishing enterprise.

Sorry for the questions, but to allow us to advise you better..

How (by what method) did they withdraw the £8000 from your account?

Was it all in one payment, or a number of smaller withdrawals?

How long have you held this account, and is it your first bank account?

Do your parents know about this and are they helping you?

kind regards,

Elsa x

This is very similar to what happened to me albeit a much larger amount. What is an online cheque? I've never heard of one. Also I know NatWest need I.D for any withdrawals over £5000. How did the fraudsters manage to do this?

Good Luck with your case.
