Any advice would be appreciated...

 

I have had a SJ applied to me from an MBNA claim.

 

The costs are in the thousands, Shouldnt CPR apply and the costs be limited to £210? Can I appeal the costs amount?

Well you haven't given us any detail.

 

What was the case about?

What was the value?

Why didn't you defend?

 

If you don't tell us the story, how can we be expected to give any advice?

Arent CPR's relevant in all SJ hearings?

My Posts exist exclusively to assist me in preparing litigation against another party.

As such, it is almost certainly protected by litigation privilege.

 

The legal requirements for claiming litigation privilege are well established and are not in dispute.

Communication between a solicitor, or the client, or a third party will be protected by litigation privilege where the communications are for the dominent purpose of obtaining legal advice in connection with, or conducting litigation in prospect: Re: "Highgate Traders Limited (1984)"BCLC 151.

I did defend the SJ , I lost

 

Judge said there were relevant points to be answered... but found in favour of MBNA,

 

it was a claim for over £8000 and the costs awarded were for over £4500

 

I have only subsequently found out that there are CPR for SJ hearing costs. My question is, am I too late to appeal these costs awarded.
