My LBA deadline passed (I have delayed going to court as I have been busy with a new addition to our household), but I received a letter form Mr McLean this morning offering me £1300 in settlement of a claim of nearly £2300.

 

Needless to say I will be sending him a courteous thanks but no thanks letter.

 

I am thinking of proceeding with my claim through County Court using the N1 rather than using Moneyclaim online.

 

I would like to ask though, as I live in England can I serve on a Scottish address - Mr McLean advised that I serve proceedings on the Edinburgh address. Other people have said that Moneyclaim does not allow this.

 

I am sorry if I have asked a question that has already been answered on here, but I have tried to search the forum and am getting search fatigue.

Of course mr mclean would like you to serve papers on the scottish address (any ideas why????) Ignore that and serve them to the london address or your branch if you want

I must say I am feeling most optomistic today, perhaps it was Northern Irelands amazing victory over Spain last night:shock: that makes me feel euphoric at the thought of taking on the 'big boys'

I also forgot to mention that when I sent my Prelim letter to Mr McLean, I sent a courtesy copy (with a covering letter) to my branch to keep them informed.

 

I recieved a reply from RBoS Manchester Customer Relations about 3 weeks to say that they were looking into the charges and that they had ordered some duplicate statements for their own benefit - which they charged ME £5 for.

 

Think this is case of left not knowing what right is doing:rolleyes: .

I would advise starting things with your Branch to begin with, it does save a little confusion between departments. The Branch will be able to organise your statements and deal with you up until you go to Court. That way you get to deal with a more human employee and can get things done a little faster. You will be allocated a case number from Head Office anyway, but dealing with your Branch means that you can (possibly):

 

a. Deliver your letters by hand(getting a delivery receipt) and watch the looks on peoples faces (priceless).

 

b. Deal with the Asst Manager (usually), ie a name and a face who will be more approchable than somebody in London/Head Office.

 

In my case, I even got a first offer from the Branch, then got passed onto Mr McLean when I said "not enough!". After that it's all through the Court anyway, still using your Branch's address for the MCOL forms.

Many thanks for the suggestion but I am acting on behalf of my daughter. She resides a few hundred yds from her local bank - and is very embarrased and does not want to even go into the bank.

 

I have just managed after a month of continual persuasion to get her to give me her account number and sort code etc - so Data Protection Act letter sent off the other day.

Well, I would still use the Branch and cough up the extra for recorded delivery then.
