    • retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free  I hope dpd will refund them so they don't lose out. Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx  
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry its been a while since I last updated this site.

I have recieved the usual letter from NAtionwide regarding my claim.

They said NO (as usual) but also gave me 56 days to respond.

What do I do now?

I sent LBA about 14 days ago now and no response yet from NAtionwide.

 

Do I proceede to Small Claims court?

Also, does anyone know how I can do the small claims stuff online?

 

Any advice would be highly appreciated.

Hi evryone,

 

Been away for a while, and have justreturned back.

So far, NAtionwide has refered my account to a third party debt collections called Roxbourgh or something.

I sent LBa in November and had it registered/signed for delivery.(although I have now lost that recipet)

So, what can I do now? Any advice please?

sorry meant to add.

 

if your acc has gone to a dca, they will have bought the debt from nwide for a lot less than you owed. This i think could be good news to you. I think when you win, instead of the money being paid off your overdraft, they will issue you with the cash. You could then call the dca and make an offer to pay the balance off in full. I would make this offer for about just over half of what you owe them and see if they accept. if not offer a little bit more.

but the problem here was that i sent LBA to Nationwide in November and never heard a word back from them. the least they could have done was to inform me. Are they not breaching some sort of rule somewhere. The account was and is still in dispute with Nationwide. Why should I pay the DCa, even if they've bought the debt from nationwide.

nationwide ignored your letter before action - so take legal action against them.

 

they ignored me lba so i have started the court process

 

you owed nationwide the money from the account when it was closed, if they hadnt sold the debt on you would have to give any money that you won straight to them anyway and you would not get a penny.

 

I dont mean to sound harsh but you know that you borrowed money from them so this should be paid back. As i said before it is extremely likely the dca will accept an offer of just over half what you owe.

 

I am not sure if they have broken any rules or not have a look at MoneySavingExpert: Consumer Revenge - Credit Cards, Shopping, Bank Charges, Cheap Flights and more go into the debt free forum and someone will be able to advise you better than me.
