Hey arni welcome to my thread!!!

 

Anyway i've just come off the phone from SC&M (I was meant to call them Monday but I thought i'd give them time to receive my AQ first) and i've just been told a SETTLEMENT LETTER HAS BEEN POSTED yesterday!!!!

 

I'm on the home straight!!!!!!!!!!!!!!

And did they say the settlement letter is for the full amount of your claim?

hey caro no they didn't. I suppose i'm expecting the usual letter with all the conditions on it i'll just have to wait till the letter arrives! should be tomorrow morning she said it was posted yesterday i'll let you know!

Don't expect the letter to arrive just yet! SC & M seem to use a stramge postal system whereby the letters are sent via Outer Mongolia!

 

Do you have access to a fax as I & quite a few others found that communicating by fax speeds up the end process.

FIRST DIRECT: £4751.86 SETTLED IN FULL 5/07/06 :-)

 

TESCO VISA CARD: £90 SETTLED IN FULL 12/08/06 :)

 

LLOYDS TSB: £4403.59 SETTLED IN FULL 17/08/06 :)

EGG: £451.52 SETTLED IN FULL 18/01/07 :)

When you filled out your AQ, in section G did you include any or all of these bits?

 

Section G - Other Information

In the space below, set out any other information you consider will help the judge to manage or clarify the claim, including any other information you consider should be supplied by the other party. Give details of any other information that you consider will help the judge to manage the claim, referring as necessary to any documents you might have attached. Bear in mind however that at this stage you need not attach all other documents which you wish the court to consider at the hearing. This is something you will later be asked to provide.

 

You should state here that you believe the case will last no longer than 1 hour.

 

You may wish to add reasons why the case is more suitable for Small Claims Track if your claim value exceeds £5,000 or provide reasoning why the other side should provide evidence of their costs! You could include similar text to this....

I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

 

However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

 

Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation.

Hey spearmint my section G was just like that nearly word for word. Anyway I've received the settlement letter

FULL SETTLEMENT OFFERED!! :D :D :D :D

with the usual 5 conditons:

 

1. The above amounts (£xx in total) will be credited to your Classic account.

2. The payment will be in full and final settlement of your claim.

3. The terms of this agreeement are confidential to the parties and their legal representatives.

4. You must agree to maintain your accounts with the Bank within his agreed limits and in accordance with the terms that govern the accounts. 5. You can avoid these fees in future if you agree an increase in your overdraft with the Bank before you try and make payments that would take you over any previously agreed limits. if you do not do so, you will again incur these fees.

 

 

I've scribbled through terms 3, 4 & 5 and initialed and then added to the bottom declaration:

 

I. groves, agree to settle my claim on the terms of this letter AS AMENDED AND INITIALED.

 

Now sit and wait for MY MONEY!!!

Cracking stuff, did you make up any kind of covering letter to accompany the copy of the AQ etc that you sent off too SC&M? A sort of rubbing their noses in it with a tone of 'Don't mess' about it? :D

I think taking them to court says that in itself. It puts the weight of the law behind you which does the job very well.
