    • 4.  Under The Pre-Action Protocol 201?, a Debt Buyer must undertake all reasonable enquiries to ensure the correct address of a debtor, this can be as simple as a credit file search. The Claimant failed to carry out such basic checks. Subsequently all letters prior too and including ,The Pre action Protocol Letter of Claim dated 7 January 2020 and the claimform dated 14th February 2020 were all served to a previous address which I moved out of in 2018. 9.   The claimant failed to comply with the additional directions ordered by District Judge Davis on the 2nd February 2024 'The Claim shall be automatically struck out at 4pm on 3 April 2024 unless the Claimant delivers to the Court and to the Defendant the following documents.' None were received by the court nor the defendant by that date. re: 13 & 15...they dont need to produce the deed, thats a private b2b document only the judge can demand sight of. i would remove 13 totally as within their WS they have produced the Notice Of Assignment. and delete it from 15 a few ideas. dx  
    • Underp04 (I think it was him) put up the statement IDR used in court from some supposed expert mr edge. can you find it? It stated 10 years was the statute barred limit but also that the laws were very confusing. very much worth digging out!

    • They wont take you to court. I'm not sure what they'll do about the letters and if they will or wont send you the letters from their retail prevention company, but you can ignore those letters. You'll be just fine don't worry.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey,

 

Last week my card got stuck in a post office atm, the atm software crashed resulting in seeing windows 2000 desktop, the machine didnt give me the cash or card back. I didnt think much of it (my mistake) thought id be able to sort it out in the branch the following morning. Upon queuing and subsequently finding my account was overdrawn I got a list of cash withdrawals and card transactions totaling £731 that happened the same day after the card got stuck. I returned to the post office and asked if she would be able to open the ATM and see if my card was in it, it wasnt (she agreed but said if it was in the machine she would not be able to give it back to me which was fine). While in the branch I cancelled the card and reported all of the fraudulent transactions. I registered my case with Santanders financial crime operations team. Im confused as to how they managed to get my pin number..? can anyone help?

 

They have said due to the criminals having my card and pin number, in these circumstances they are not able to take responsibility for the loss.

 

Any advice will be greatly received!

If you have not done so already, go to the police and report it as a crime and get a Crime Reference Number.

 

Contact Santander and tell them that you have notified the Police and give them your Crime Number. They will then take you seriously.

 

The Police should contact them and inspect your accounts and their records on approving any of the transactions.

 

Santander will probably pay the money back into your account whilst the investigation is on-going.

Beware of Santander and card fraud. My card was cloned but the bank will not accept this. It was used in London 3 times in a short time whilst I was in the North of England where I live. The account was checked twice and then money withdrawn at a different site a few minutes later. As the card number was correct and also the PIN they say I have given my card and number to someone. I have not done this and would never do this. The card has been permanently cancelled by me and the account will now be closed.

Thanks for your reply. It was a cashpoint card so presumably they expect me to deposit lots of money so anyone else can take it out. Another bank is getting my money now. I have logged the fraud with the crime cente managment via the police. I think people need to be very carelul as it is not a simple matter of applying for and getting your money back. (Some banks etc. however have responded well to such frauds recently.) No ATM can be seen to be secure no matter how careful you are. Also the Bank has mispelt my name and address (twice). Makes me feel very valued as a customer. I think my Santander shares will be sold soon!

Santander have not been helpful to me either - I know your post was a long time ago but feel I had to respond to it as my problem is very current. I have always had my personal cash card on me never left it anywhere. Since Feb this year I have had substantial amounts of money be taken from ATMs locally. I requested statements and never received them and still havent since Feb this year...

 

I recently requested an online account so i can check all the transactions and low and behold there over 20 transactions using cash machines that i do not recognise. Having contacted Santander fraud department, they looked into it and then told me nothjing they could do because if it was fraud, the fraudsters would have wuiped my account clean and not withdrawn bits here and there. On a couple of the transactions - I have alibi's. But, because they checked my details and have seen that my card has not been cloned - how can they possibly tell this - the person taking the money has my card and my pin number to do so....

 

I am entitled to none of my money back and they are taking it no further.

 

Anyone have any thought or help?

Thank you for your email. I am sorry you too have been a victim. Although Santander knocked me back I logged the crime with the local police. They said if it was not resolved it would formally be made a crime but if resolved it would be dismissed. Thankfully Santander took notice of my crime number and suddenly admitted my card had been used at a rigged machine in London the year before. Prior to this I was guilty in their opinion. It was a long time before I noticed the withdrawals had happened so I lost more money than I originally thought .This was due to my own fault as I should ahve been more vigilant. Santander have no right to say they would have taken all the money out of your account. It happend to me on 4 occasions . They took small amounts each time and then as more money went in they took another amount out. This happend in London, Newark and 2 other places. I know it sounds stupid but my main bank was Halifax and I only used Santander for dividends from Santander. I got statements 4 times a year and did not take any notice of them. I know better now than to trust any bank. Once I got some money back from Santander I closed the account. The cashier told me that the machine inside the bank had been tampered with! I change my password frequenly now and try not to use cash machines. Money back at the supermarket is the best option. I will not be banking with Santander in future. Final message to anyone reading this. If you have not yet had your card cloned, believe me it will happen.

As you were no longer in possesion of the card, Santander might feel you shouldve contacted them and cancelled the card.... you didnt for at least 24hours, so i can understand why they might be refusing...

 

Fraudsters have come up with all tricks to steal your pin number, and possibly they might have been able to get machine to boot up, thu you walking away....

 

I would ask the police if they are aware of any fraudulent activity on this cash machine, thn re contact Santander.

 

Also it was a cashcard not a debit card..... so why did Santander let it go overdrawn?
