      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a tv with buy as you view. It's a sharp aquos 47" LCD. I could buy a samsung 50" for around 500 now so it makes sense to buy one and stop paying £104 every 6 weeks.

 

I would like to know the best way of giving my tv back, also the main thing is if this would affect my credit score.

 

I have had the tv for 11 months.

 

The agent is coming to collect £104 tomorow so it would be helpful if I know exactly what to tell him.

Hi - and welcome to CAG.

 

You can voluntarily terminate your hire purchase agreement at any time, but you will be liable for 50% of the total amount payable (less any remaining interest and any "add-on" service contracts you may or may not have.) Dependant on whether your agreement was for 2 years or 3, you may well have already paid more than 50% already.

 

You would probably be better discussing this with the customer services dept at BAYV head office rather than with your rep.

You would probably be better discussing this with the customer services dept at BAYV head office rather than with your rep.

 

Having said that there may be mitigating circumstances to be taken into consideration.

 

I would suggest you write to the company at the registered office adressed to the Chief Executive Officer marking this "private and confidential" to ensure a senior manager sees this letter.

 

Further send this registered post and keep a copy, state you situation and what you want the company to do and give them 14 days to respond in writting.

 

Provided you reach agreement with the company no adverse action or record would be made

The response quoted above was (I understand) posted by a senior director from BAYV, although the poster prefers, for some reason, to remain anonymous...

 

The company registered here at CAG, insisting they wanted to improve their customer service, contribute to threads, and be more transparent to their customers...

 

THEN WHY DOES THE COMPANY NOT POST UNDER ITS OFFICIAL ID OF "BAYV"? (This ID was also registered, and has posted more than once on these forums!)

 

I shall say this one last time: If Buy As You View want contribute to CAG, and be seen as transparent to their customers, then BAYV should only post in an OFFICIAL capacity with the ID of BAYV, and not under an alternate ID! This is both unprofessional and unacceptable.

 

I shall unapprove any further "official" BAYV posts UNLESS THEY ARE POSTED BY BUY AS YOU VIEW WITH THE USER-NAME OF BAYV

BAYV have been given ample opps to show they are serious in addressing CAG complaints.

I am with Lefty on this,that in that despite a number of requests,things dont appear to have been digested that enables transparicy and openess.

I'll check when I get home but I think the agreement was 3 years. What if I say I'm not paying any more so they reposess the tv? Does this then show on my credit file?

hi there, i had a tv from bayv, and because of circumstances i couldnt afford it no more so i asked the person that was coming to collect payment to take the tv away that day, hesaid some one will be around the next day to collect. I didnt haveto pay anything apart from the payments i already made and the payment that was due when he came i dont owe them nothing its not shown up on my credit file i just cant get anything else from them for 6 months
