    • As above so it is essential you don't appeal and accidentally reveal who was driving. Stay quiet to Met and their pet DCA unless you get a letter before claim.
    • Hello, welcome to CAG. Thank you for the information. To answer your question, we don't recommend appealing at all. It will be a waste of your time and you could end up outing the driver. Ask any questions that you have but basically you keep an eye on this, keep the correspondence and if MET ever they send a Letter Before Claim/Action.     • Hi All, Can ii get advice on this PCN received at the services near stansted airport. Picked someone up at night and went to grab coffee and snack in mc Ds, and didnt realise there was zones in this car park, it was late dark and pouring with rain so obvious u see the large 60mins parking free and dont stand around reading everything. My son and his mother were in the back of car still as he was sleeping.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Am posting for my next door neighbor.

Story is they bought a washing machine online from Argos direct using Argos card.

Shortly after machine broke down,and someone came out to fix it.

Not long after it broke down again-and again was repaired.

Now broke again-Argos are claiming guarantee has expired.

Although payment was taken on Argos terms -full balance of machine was paid off so machine is fully paid-is just over 6 months old and doesnt work.

Thoughts please.Ta.

How long did the Argos guarantee specify? 6 months doesn't seem to be a lot, manufacturers usually offer 12 months. In any case under EU legislation, the manufacturer is liable for 2 years for manufacturing defects.

 

Nothwithstanding the above, I would suggest that your neighbour also has a case under SOGA 1979 reference S14,S48 & S49.

 

Perhaps a well worded letter to Argos HQ mentioning their legal duties would do the trick; failing that it's a visit to the court again I suspect.

Yes this was my initial thoughts.

Trading standards or Consumer direct would want some proof that dialogue had failed.In the absence of giving Argos a chance to meet their oblgations and having proof that they did not,means the regulators would be unlikely to get involved until that happened.

This is why I always advise to put something in writing to get a response that can be used to demonstrate dialogue had not brought about any result.

But as we know,putting something in writing and sending recorded delivery will very often see things happen sooner rather than later.

And maybe while they are here they can have a look round.:)

Hi, Julie next door neighbour here!

Sorry Martin, didn't explain myself properly...Argos aren't saying guarantee has run out. I was just saying they seem to be stalling & fobbing us off in the hope that it soon will!

 

History of machine is:

Engineer came out when machine was only 1 month old as machine wasn't rinsing/spinning properly. Engineer fitted chips and then decided it also needed a new circuit board. Engineer returned to fit circuit board a week or two later - and after he'd gone we realised his "repairs" had achieved nothing and machine still didn't work properly.

 

Two weeks ago machine went completely on the blink - cutting out halfway through a wash - so we phoned them again. Engineer came out & we told him we didn't want it repairing again as the first two repairs hadn't worked & now the machine had a completely new fault. Engineer turned the machine on & saw it switch itself off with his own eyes. He agreed it was faulty BUT then sent a report to Argos stating that we wouldn't ALLOW him to repair it! No mention of its repair history or our reasons for not wanting it repaired again.

 

So now Argos are being very difficult & basically saying the machine is still repairable! My husband spoke to a lady from Haier (manufacturer) yesterday who said they would be speaking to the engineer who came out last & also speaking to Argos and then ringing us back tomorrow. Parts have apparently been ordered again....so she's going to ask the engineer what parts he has ordered for a machine he never even got round to inspecting! Should be interesting!:)

The onus remains with Argos to sort out this mess-thats who your sale contract was with dont let them say its the manufacturer.

 

Also....if you were given the same chips that I was given from the Shere Khan....I would be very suspicious of that.

Can I just stress this was the neighbour on other side not us. We only blast Patsy Cline at 3 in the morning in this house, no Dolly! :lol:

I think they were Shere Khan chips now that you mention it. He did disappear over the road for a bit & came back smelling distinctly of onion bhajis!

 

Seriously though, thanks for the advice. I'll update you on tomorrow's instalament in what may be a long running saga!
