    • They have been sending messageslike " Do you want a refund or not"  which ive said im at work just try and avoid their childish obstuctive replies as ive had enough of them but i plan on going up tomorrow , so my question is,  they have to give me a refund dont they, they can not bargain or refuse the refund if they havent checked the phone first ? Their previous messages have said they want to check the phone first before a refund is given and i think theyll try this tomorrow as they have argued all through this .... If that happens can i just walk away and then send the letter of Particulars which is due next week ? Edit :   Just for the record the phone hasnt been used since buying its been put in a protective bag and put in a draw , its in the same condition as i bought it

    • Hi there   thank you for the reply. No, it's not a silly question at all. I am convinced I didn't hit anything with my car. I was going very slowly and it was the guy standing next to his lorry in the road who punched and kicked my car as I went by. It's cause I saw him do it in the mirror.  I initially thought he did it because he thought I was passing him maybe too closely whilst he was messing around with his lorry ?  That's why I stopped and got out and asked what he thought he was doing hitting my car. He then just hurled abuse at me. Not making any accusations such 'you hit me' 'you hit my lorry' or you did this or that. He just swore and shouted at me. At which point I said I would be making a complaint to his company for his threatening behaviour and vandalism for punching my car. I went to my car , got my phone to take a photo of his number plate but then he came towards me again and I thought if he now hits me I am going to come second. I am a woman in her mid 50s travelling on her own and this guy looked like a Millwall football supporter (short, rotund, skin head) so I decided to leave this situation. I got back in my car closed the door and drove off before he could reach me.  I later checked my phone and noticed the photo was too blurred, as I turned and rushed back to my car too quickly before the camera could focus. So I thought it was pointless making a complaint as the guy couldn't be traced anyway, so I forgot all about it until yesterday. But this is all I can think of, it must have to do with this incident as it is in the same street.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

 

Basically I Got issed a Default by next on the 22nd of February 2008, I have recently written to them for a copy of my credit agreement and they have responded with this.

 

"I note that your account was transferred to an external collection agency on 22nd February 2008, I can Advised the debt was recorded on your credit files now shows as a satisfied default, as full and final payment was recived, it cannot be removed, as we have a morale duty to report all of our customers credit history accurately.

 

As the Balance has now been paid, under section 78.3 of the comsumer credit act, the agreement is now closed and we are not obliged to supply you with a copy of the orginal credit agreement.

 

Thank you....etc"

 

Now i orginally requested the credit agreement to be sent within the set timescale of which ends on the 22/07/09. How long are they required to keep the orginal credit agreement for if one exists of which i know it doesnt.

 

How am i to respond to this, I have read over the next default threads i have found but they all seem to be about accounts with outstanding balances and debt collection agencys.

Any help would be appreciated.

Hi,

 

I have a dispute with next at the moment and my account was closed in 2006.

 

I am trying to get a default removed from my file when they passed my debt to DCA. i sent them the CCA request and they have to by law to send you the items that you need. If not they are in breatch and you can report them to the ICO.

 

Have you sent them the CCA request for the SAR??

 

Next has confirmed to me that they can not locate a signed agreement for me and they are being total assess! i've has to refer the matter to the ICO.

Bank Charges refunded from halifax joint account £554

Credit Card Charges refunded from Halifax £300 plus interest

At the moment all i have done is sent them a letter asking if i could have a copy of my credit agreement of which they responded with a letter containing the statement i orginally posted, I am going to sent them a Subject access request now and see where that gets me, i think ill send that out at the end of next week that way ive given them the 12+2 days, let me know how you get on with the ico, did you get it in writing from them that they could not locate a copy of you agreement?

Yes, i have it in writting from them. I'll let you know how i get on. I feel that our complaints are going to take a very long time :-(
