Dear all,

 

have just received a letter from FBI (reading) regarding my HFC (Marbles) acount - for the last 4 years I have been paying Lewis debt Recovery a minimal (£20)/month amount. Today FBI informed me that

 

'an agreement dated 18th May 2009, HFC bank sold and assigned all of its rights, titles and interest in, to and under, inter alia, your above agreement and related security to TBI Financial Services Ltd.

 

Our records indicate that you are making repayments to HFC Bank or its agent The Lewis Group Ltd. Please forward all future payments to this office.

As all the records relating to your account are now held at FBI ltd any query that you regarding this matter must now be dorected to the above address.'

 

as usual I have 10 days to reply to this letter - the monthly amount has risen by £50 and they want a financial breakdown - which I do want to give them even though my monthly incoming is £0 as my firm has just gone bust

 

May I ask you to help me in this matter - Whilst I admit to 'owing' the amount (approx £4800 now) am I right in thinking that TBI now have to prove that they own the debt by producing a signed CCA - if they cannot do I owe them the money?

 

Should I request a CCA from them (thank you for the details) - if one does not come back am I OK - if one does come back is there anything else I can do.

 

Am I shafted because I have been paying (i.e. an implied contract even though no paperwork may exist)

First thing is send off a CCA request, tell them as you have just lost your job they'll have to accept £1 a month (or even nothing) untill circumstances inprove.

 

You where paying the OC as you thought you owed them something, you know you do not owe the DCA anything because you never signed a contract with them.
