Hi

 

We have received a default notice from MBNA, but we have sent them FOUR requests via templates here for a valid CCA. They have not responded to these requests at all, and deny having any contact with us. (yes we did send the postal order and recorded delivery thing, twice)

 

What can we do about this? They said in one of their letters "in case you didnt know we are not actually required by law to provide you with a copt of your CCA"?????!!!!! :-x

 

Anyone got a ball stamping letter to send, bearing in mind we have sent the CCA request one out and the chaser CCA letter one already?

I wouldn't chase them for anything - do you really want them to find the agreement?? They have your request and cannot fulfil it. All you have to so is put the account in dispute untill they do fulfill it. If it is an old MBNA account, they put them all on microfiche and have a devil of a job finding them. Then when they do find them, they have usually put a big date stamp over them making them illegible - the copy must be legible - and the writing is too small to read. I would sit back and let them make their empty threats. Without the original agreement, which they clearly don't have, they are going nowhere fast. Sometimes the less contact you have with them, the better.

Is this really the case, wow didnt think it would be that easy. But surely they have no right to put a default on the account? Is there really nothing they can legally do until they provide that CCA? so any letters they send from now on we can just ignore?

Hey 'paws. I'm in the middle of CCAing MBNA myself, also a first timer. Today is 30 days since the original CCA request. I have sent them the follow up letter too. They have not responded to either. I have proof of posting too.

 

Any chance you have been contacted ny either Aegis or a company called 'Global' something or other?

Nay. neither of those companies. I just dont get how these companies operate, and also how many people they must frighten to death with these letters they send too.

 

Thank goodness for this site or we would be in a big pile of poo by now

Agreed. I feel so naive about all this when I'm actually a pretty switched-on and assertive person in all other areas of my life!:)

 

 

I can't believe that they're on the phone day and night when people are late paying or whatever but completely ignore legal requests sent via Special Delivery!! :-x
