    • According to Wikipedia - yeah, I know - the site is owned by Croydon Council. It's at least worth a try to contact the council and ask for a contact in The Colonnades.     • 4 hours were soft play with the kids then moved to one of the restaurants for a meal. Restaurant took ages with our order but it was a group of parents so we were in no massive rush.  Ive been trying to find how to determine 100% if the road is public or not as I just based my assumption on the street signs, traffic lights and the bus. Regarding the PCN, does it covers all requirements needed to enforce or do you guys see any clear weak spots? Considering the size of the place and different areas and businesses reachable through that road where the cameras are, I believe is a massive assumption to use those photographs to calculate the time someone was actually parked in a designated parking spot as there are numerous other areas to load, unload, wait for people, drive throughs of restaurants, etc all within the area accessible through the one road where the ANPR is. One can go through most of the areas on street view in google. You can even see a car parked in the middle of the roundabout for example.

    • and it legally informs them of your correct and current address as you must do with all old debts last paid/used in say 7 yrs you dont want backdoor CCJ's. what were the names of these IVA scammers, the one you took it out with, and the one that scammed you to let them take over please? your story is slightly worrying. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Received this response (attached) from Sainsburys today following my CCA request about 12 days ago. Have they sent me the right thing - there are no signatures etc on this form. Should I be requesting something different in order to get a copy of my original signed agreement? If they have sent me the right documentation through is it enforceable? What do I do next? HELP!!!

its a bit small

 

can you upload by googling photo bucket

 

under the new cca regulations, a creditor can send you a manufactured copy of an agrement to comply with the cca

 

thats why no sig

 

but

 

they need the original to enforce

 

its smoke screen and mirrors

 

no cca

no liability to pay, only on your terms

Thanks for your response. Is there a way I can make them provide me with a copy of the original signed document? I've seen some stuff on here about Subject Access requests - is that what I should do next?

 

I have uploaded the scans to photobucket but I can't add them to this site. I get a message saying invalid link??? I'm new to photobucket so I am probably doing something wrong but I can't work out how to get the link on here - any suggestions?

I can't be sure because there is noting on this paperwork they have sent me with either a signature or a date on but I think it was around 2004/5.

I am in the same boat, same letter, same copy. Got this today.

 

Why are banks not following the rules correctly?

 

What reply should I send? There is no mention on these documents of the credit limit ect.

 

I have tried the data protection access request too but that has failed. (Outside of the 40 days.)
