    • I live in a student house, with 5 tenants, unihomes is our utilities provider, who we each have a direct debit set up with and have paid each bill every month. Two letters were sent in my name by BWLegal saying I had two outstanding payments due adding up to over £3500, I have tried to contact british gas (as that is apparently our houses provider) as well as Unihomes. Nothing has helped and BWlegal are pursuing legal action if these debts are not resolved by the 1st May. What do I do? I've called Bwlegal when i bring up that the debt isnt for me and for unihomes they hang up on me. so I am stressed and do not know what to do

    • Hi, everyone. I received a letter from TfL investigator/Prosecutor. The letter reads as follow:   ''Thank you for responding to our enquiry letter. Your comments will be taken into consideration when reviewing whis case and we will contact you as soon as we have reached a decision. TfL now consider prosecution against passengers who are in breach of all TfL byelaw offences and I must inform you that further legal action may be taken. TfL byelaws can be found at ... Please do not hesitate to contact me if I can assist you further.''   The letter was sent 23 days after I replied to them. Should I send another begging letter to IAP? I'm extremely scared now. Thanks all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys

 

I took out a £2000 loan with wf back in feb 2007 for a 2 year duration. Last year when i lost my job 3 payments went a little wonkey, but i soon recovered when i found a job and could only make the minimal direct payment out of my account. While i was missing the 3 payments welcome would ring me up and would happily say the missing 3 payments could be paid at the end of the term( effectivly over 2yrs 3 months). They did not tell me that i would be accruing extra charges on my account daily! for these missed payments. So imagine my suprise when i rang up last week and still found that i owed £1200. I am shoked that they did not tell me that they were going to penalise me for these payments. I hit them with a S.A.R and they sent the statements through!

 

To make matters worse i cant even work out from their statements they sent me, to what i can claim back? i have posted these statements for all to see any help would be greatly appreciated. I should have 3 payments left to the value of £450, 3 x £145ish so someware along the line i have inherited a further £750 in interest

 

If somebody kind enough could spare me a few moments of thier time i would be greatly appreciative i have atatched the 3 statements.

I am in a similar position.

 

I asked Welcome for a copy of my agreement (June 2007) under CCA and all I received back was one A4 scanned page which is virtually unreadable due to the small size of the print.

 

They also sent through my statement which is littered with charges for "Add Hoc" fees, telephone fees, letter fees and outside letter fees.:confused:

I am not sure I can try to claim any of the charges back as it is a post-April 2007. I will keep searching on here though.

No i dont have PPI but i do have something called life 24, for which they charged me £195.00.. Any ideas?

Life 24 is a PPI. I would start trying to claim these charges back, it costs them nothing to tell you the card payment was declined whether you phoned them up or went in office to pay them you were there so they knew at the time, and yeah capitalisation and interest...it states on the statement they are the same thing, I'd love to know what the ad hoc fee's are for... thats like me saying I have written on here and am going to charge you £5 for writing plus and extra £5 cos I feel like it.

 

some of the more knowledgeable caggers will be able to tell you the process but seriously start a claim back if you can...

 

do you have the original agreement? if so can you scan it on too please

Today i worked out the full extent of my wf account!

I have come to realise that i missed 4 payments over the course of a 2 year plan. The loan should of finished its final payment back in february. I thought i should extend the payments over a further 4 months. After making payments in March, April, May, and June 09, all payments have been covered which leaves me asking, what shall i do next?

 

I rang and spoke to my account manager last month and he said that i still owe about £1000. It was a civil conversation and i asked what can i do appart from cancelling the direct debit mandate (and quoting unfair penalty charges that i have recieved back off of the bank).

 

Fair play to the chap he advised me against this because of the debt on the account, he said write in and we will open negotiations on the account because we (welcome finance) do not want to be left with a bad debt, and of course damaging my credit rating. Not forgetting the harrassment calls etc etc! But im still not to sure think i might cancel the dd, and bite the bullet!

 

So in a nutshell the charges are in my pocket, not in a financial institution, so how do i go about keeping them this way?

 

Basically im looking for advice and a letter that i could send them.

Yes i do have a copy of the original Agreement buts its a copy that i requested. So you guessed it they posted it out with really small text size!:(

 

I can read what it says, i will have a go later of magnifying it and then posting it.

Life 24 (or Lifecare 24) is a lump sum life insurance policy, which would pay out a lump sum in the event or your death! Do you have the policy documents?

 

The £750 added to your loan is the charges for 4 missed payments plus the interest on those charges.
