      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes it is as easy as that. I didn't know what compound interest meant either (though I knew it was an amount that would equal the value of the interest over the years on the charges as they were put on).

 

Took around 30 minutes from call to MBNA to getting a second very efficient call back from Paul Miney to get my original claim of £1316 increased to an on the spot offer of £2400 (£620 of which was already credited to my account as goodwill).

 

This will be with me in cheque form (no credit being applied against £1000 i still owe) within 5 days - I was even advised to do what I wanted with the money and only pay off the balance if i wanted.

That sounds good to me. Thanks a lot, I'll be on the phone tomorrow all being well. I reckon the £1,160 charges plus the compound interest should clear the balance i owe them (£1,860). That beats paying £50 a month and having only £5 come off the balance.

Wow, I only accrued £98.

 

I was doing some financial admin about 8 weeks ago, and closed my account.

 

They for some reason have credited it with £40 which is strange as I no longer have the card.

 

I am going to phone Paul tomorrow, and look forward to the result !!!!

Just made my initial call to Paul Miney, he wasn't at his desk but the lady i spoke to was very pleasant and helpful and she said Paul will give me a ring back within the hour.

All being well, the next time i post on this thread it will be to say that i have got all my bank charges plus compound interest back.

Just spoke to Paul Miney, again very pleasant to speak to. I told him that i wanted the remaining £620 plus the compound interest on the full £1,160. He said he would work the figures out and get back to me within the hour.

 

He also managed to get the account number for my old MBNA account and said he would get me the information as to the amount of charges made against that account.

 

Not sure if i'll be able to sort both accounts out today but it was definitely was worth the phone call

Yep - for the cost of a phone call, MBNA do seem to be settling claims - good call going for the compound interest as well.

EXCELLENT RESULT!!!!!!!!!!!!!!!!!!!!! got a phone call back from Paul Miney 15 minutes later.

he worked the compound interest out and added it to the £1,160 charges, imagine my delight when he told me it came to £2,247.35. Definitely go for the compound interest.

 

He said they would clear the balance of the account and send the rest (£385.35) to me in a cheque.

 

He also said that he would request the charges on the other account and work out the compound interest on that, then he's going to write to me next week with the total. Its then up to me if i wanna accept it or not.

 

A TOTAL PLEASURE TO DEAL WITH.

My account has been credited today with the 1160 as Paul Miney said....top man!

 

As for compound interest...it means that interest is charged on the sum owed plus the interest its accrued. Banks charge compound rates because they ramp up more than annual. Now they have to pay it back! There are sites that will work it out for you

Thanks jim. I didn't know about compound interest when i made my first claim for £2,700 againtst A&L, which is a big shame, i bet that would have topped £5k. But i did ask for it today and Paul Miney was happy enough to work it out for me and it doubled my claim. Thanks for the links for working out the compound interest, i've still got another 3 credit cards to have a go at yet, so hopefully the interest should bump these claims up quite a bit.

Fantastic result Lee. Sounds really good. Call me cynical, but I would still want my SAR complied with just to check the charges were accurately calculated, but this is an amazing result.

Thanks caro, i know what you mean but i think to be honest, its a lot more than i thought i was gonna get so i'm more than happy. Besides i have another account that they are working out for me without me even sending any letters, i dont know why but i just feel that i can trust them, and i know how stupid that sounds!! Besides if i don't think it sounds right i will request my S.A.R. I just wish that they were all so happy to settle, just think how much time, court costs etc the banks could save themselves if stopped been so petulant. Still waiting for my cheque from A&L even though they filed an acknowledgement of service 3 weeks ago

Thanks for keeping us up-to-date. I'm another customer trying to ercoupl those unlawful charges from MBNA for 3 seperate accounts. I really just want it resolved quickly and speedily so your story is good news from my point of view.

Bank and credit card reclaims - £9,806

Sainsburys CCA non-compliance with FOS;

Natwest reclaim of £340 in progress;

Egg credit card reclaim in progress

My first post:

Got my statements this morning, found £480 owing. Just called the number on the previous page. Paul wasn't available, but the lady I spoke to asked me to send an E-mail with my complaint to:

[email protected]

She acknowledged that accounts have been sorted out to satisfaction over the phone, but noted that the initial complaint should be put in writing first.

 

E-mailing them now. :)

got a list of charges for my second account, it came to £436. Got a goodwill payment of £160, rang Paul Miney told him i wanted the full amount plus compound interest, received a letter 2 days later saying they are sending me a cheque for £1,182.30. THATS NEARLY £750 IN COMPOUND INTEREST!!!!!!
