I owe Natwest/RBS around 15k in total.

 

Under the current circumstances for RBS do you think they would be open to a full and final settlement offer of about a third of that?

 

Currently I am in a debt managment plan and paying them each month through this, but this will take seven years to pay off.

 

As the bank take any opurtunity to take advantage of us - do you think I could take it of them? - do you think they would go for the cash now?

donlt know but no harm in asking remember to add key points such as no other company can persue for the remainder etc

If you write to them explain you have a family member willing to settle some of your debts and if they want to be included you are prepared to offer £xxxx as a F&F. if they are unable to accept your are quite willing to abide by the DMP. GOOD LUCK

Is this a loan, credit card, or overdraft. SirHumpy?

 

If either of the former, have you ever sent for a CCA? If not suggest you do so asap. It costs £1.00 & they have to supply it within 12+2 days. (Don't sign the letter, send PO & Rec. Del) If they cannot provide a CCA (or it is unenforceable), you stand a much better chance of making a F&F bargain.

 

If they have an enforceable CCA, suspect they won't go for your 33% deal. RBS may be desperate right now but they're not yet quite broke!

Its a mix of loan, credit card and overdraft from a few years ago.

 

I recently asked the DCA that started bothering me for CCAs but they went away quite quickly afterwards - and the bank are dealing with this again - they said they never passed it on. I got sent my POs back from the DCA involved.

 

Do you think I should first try to get the CCAs? - then if they are weak use this to make an offer - or will the fact I'm making an offer give them ammo if I say they cant enforce?

loan and card are covered by cca, overdraft from bank account ?

 

how long ago was the loan and card taken out?

Overdraft from bank account.

 

Loan and card from 2004/5 - but payments were made until 2006 - then DMP after this. No PPI on either.

Suggest you send for the CCAs on the loan & CC, they should have provided you with an 'agreement' for the overdraft but it won't be in the form of a CA.

 

If these are from 2004/5 it's possible they won't be able to find the agreements in which case you can then decide whether to settle (at a greatly reduced figure!) or take your chance in court as to getting the debt declared unenforceable.
