    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Love yourself, send them love, too.

Seriously - I would rather send them a CCA request/prove it letter/BOG OFF letter and save my lovin' for someone who deserves it

Not only the prayer card, a compliment on how great he's looking today, too and a great big smile and a thank you so much. You're not doing it for him, you're doing it for you.

Yeah, I'll let the bailiff in too eh? Let him take an assessment of my goods and give him the right to enter my home forcibly next time........

Make a mental note to remind yourself of this statement in a thousand years.

If I am still alive in a thousand years, I won't need prayers to pay my bills - I'll be rich as I would have found the way to live forever.....

Seriously, this has cheered me up (not much does that at 4.20am), but not in the way you think nick-name. If you believe this, then good for you. Me, I personally think that the only way to pay your (enforceable) debts is to actually PAY THEM.......

That is how quick the mind can pull you back in to negativity and also why I recommend WRITING because it engages your brain more. Doesn't leave you with the attention span of a goldfish.

That's rather rude......I think you will find that CAGgers do indeed write - to the DCA's/OC's with CCA requests etc.....that's what empowers us on here. Not some gobble-de-gook about blessing our bills. I don't think my landlord would go for that to be honest.

This thread is going way to far now. I will be making no further addition to this thread.

oh, and when you do, can you please not edit the post like you have all the others, if you've got something new to say then can't you just say it in another post rather than changing the ones you've already writen.

talk about covering your tracks!

Actually, this is my last post - happyfeet, stop feeding it :D:D - oh, and you now have 2 blobs......wonder how you managed that ;)

Sorry mate, but I couldn't care less if you were one of God's chosen or one of Satan's minions, no excuse for being rude, and to say you're not here to be polite, then you're probably best off not being here at all. This site has many people that have been helped by real solutions to pay their bills. Not by blessing them, or being told to write them down by someone preaching the good word. Sorry, but that's how you've come across to me. Test the water a bit, see peoples reactions, then throw God's name into it

A lot of what you say probably could help people in the long run, who are willing to give it a try, but at the moment, when DCA's are at their door, no money to pay bills because everyone is either being made redundant or getting their home repossessed, your theory is of no interest to them, whether or not you may think it will help them.

I'm not really bothered if you disagree with me, I'm just expressing my opinion. Sounds very Dale Carnegie if you ask me...

Well said.

Make sure you bless your empty bottles and stick them in your drawer, and your hangover will be gone!

I have sworn on all the empties. They should be full, but no.....the bless'ed things are all gone. No amount of praying is gonna bring them back :(

Ok, am too drunk now and should not be posting. Took me 5 minutes to write this.
