      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cor Blimey Beachy, and that was toned down, my gawd what was the XXX version then.

 

Thought I'd better remove some wording - libel comments sprang to mind, didnt want to lower myself to their level - special thanks to CB for proof reading.

 

I agree with you KB, the only way this can be sorted out is in the courts, I would never have 'locked horns' with C1 if they accepted we were/are in deep financial trouble & accepted the NDL budget planner - now its out & out WAR !, I'm convinced now that they dont have originals.

Although I have disputed the account based on charges, I have received(yet again) a reply from capquest stating that they have been instructed by capone to carry on with collection activities, capone will deal with the dispute (they have only offered a £12 refund :shock: ), surely capquest arent allowed to pursue a disputed account.

 

Capq are only collecting on behalf of capone.

 

Currently dealing with three bereavements within eight days and can well do without these leeces at the moment. :Cry:

 

Any advice would be most welcome.

Morning fellow Fan Club members, just updated my own thread & thought I'd update you all via Sunflowers Fan Club thread.

 

Wrote a strongly worded letter (thanks Shadow) re: CQ threats, and have now received a letter confirming CQ thrown in the towel, dropped it like a hot potato - account now returned to capone :grin:

Morning fellow Capone sufferers

 

Well it looks like my coach trip is off (sorry), although they've not refused I received a letter from them this morning along with 'a true copy of my agreement' together with pages of T&C's which are completely different to what they orginally sent me under my cca request - the original t&c's quoted £12 late/over limit fees, these latest one's they've sent quote £20 :?

In short there aren't any

 

The 'agreement' is a single sided A4 page enclosed with this is three A4 pages of T&C's without any prescribed terms and reference to T&C's sections 1 to 22 (will scan these up if it helps )

Woops hold on T&C's are double sided :-

 

T&C section 3 - We will set & notify you of your credit limit

this is repeated in section 10 of the T&C's together with APR for purchases; balance transfers & cash withdrawals.

 

There is a section 23 which relates to 'use of information' You agree that we may hold & process, by computer or otherwise blah blah blah

The strange thing about this set of T&C's is that they state late/overlimit fees are £20, but I have only ever been charged £12 (as stated in the first 'original' T&C's they sent :?

Hi GK,

 

Good to hear from you again, the 'agreement' is no different to the one they original sent out and the one Capquest tried to pass off, its the bit in their letter referencing the scanned first page.

 

Secondly the t&c's they sent are totally different to the first set.

 

My request to them was for me to travel to Nottingham and view the original (and afterwards meet up with you & keefyboy for a pint :) ), sadly by the look of things capone wont allow this to happen.

Seems they are sending out loads at the moment, perhaps their short of money and tryin to sell off their books.

 

DD Sounds good to me, really got annoyed when they wouldnt let me visit Nottingham to view the agreement and end the dispute.

No, I feel like you - left off the list :( Mind you theres still todays post to spoil things for the weekend.

 

Possibly one good thing that may come out of this - if the Leeds Losers have bought all the Caggers capone accounts they aint gonna get any pennies in return, so it could spell the end of them & send them down the U bend :D

Let's write on Monday as CitizenB has just reminded me that there's a postal strike on from next Thursday.

 

I knew someone years ago who if he had problems getting money from anyone used to send in this really stinky old tramp to sit in their reception area. Maybe we could find one and send him to sit in capone's or lowell's offices? :D

Mine is still in capones filing cabinet after beating capquest, its the OH's thats been sold to cabot.

 

What capone sent as a make belief 'agreement' was in their words 'a scanned image of the signature box' :D
