    • Hello, firstly thank you for reading this. I know no one wants a long winded back story. So I’ll be breif. I entered a local store to buy some paint (which I did pay for) I am honestly not a bad person or a theif.   Didn’t have a basket or trolly as was on my lunch break. Whilst picking up the three tubs of paint placed some masking tape in my pocket (it was hanging out of so I had every intention to pay) just didn’t have a hand free. Paid for my goods (forgot about the £4.39 masking tape) I’ve got so much going on and im not well at all (like I say no one cares I get that) also have autism so wasn’t thinking particularly like others do maybe (who knows my minds going around and around) I left the store after paying, was pulled back in by security. Asked for the tape which I gave immediately  shook up. Gave them my ID and details. I was given some paper and told to expect a large fine in the post for their time and the tape and sent on my way. my questions are: I hardly ever go out without support so the ban I guess I can’t go there now for anything (their loss) - ok but is my photo going to be all over with my name? how much am I expecting in the post as a fine? I have sent them cash in the post recorded signed for delivery to arrive tomorrow (incident happened today) for my error. Their Address was on the bit of paper. i have read two posts on this page but they were from many many years ago so I hoped for updated advise please?

    • So should I send them a new SAR and put my date of birth on it? Or do I need to send them some proof? Driving license?

    • utter BS, doesn't matter you signed it. pers i'd be writing as per the other threads here rejecting the car as not as described under CRA etc and be done with it. as its a debit card you could also do a full chargeback within 120 days to your bank and simply dump the car back to BMW. 100's of like threads to read here. get your ducks inline. make sure you know what you are doing and off you go. dont take any BS from BMW, no matter what you sign it does NOT remove your consumer rights. p'haps it might be on the off chance you are a good manager , a quick phonecall tomorrow saying you dont want it because (no bla bla fitted) it might be resolved in 5 mins..i will guess to date you not tried

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi folks

I am currently at the stage of sending the Bank of Scotland an LBA, claiming for the sum of £4430. The sent me a standard (bulls**t) response, saying sorry you're not happy, we'll investigate your complaint blah blah blah! :mad: The LBA goes off tomorrow along with a schedule of charges (which they already have), so fingers crossed for a +ve response.;)

Just a quickie to say that I sent the BoS their LBA letter today, along with a copy on the charges schedule. Let the 14 day countdown to moneyclaim commence...:smile:

How many others have had success calimimg against BoS? Interested to see if they'll take me all the way.

I sent off my LBA on friday, claiming them for £3075. Got a phone call from them today offering me £375 to drop the claim now. I have refused am am waiting to see what their next step will be.

ianmc, that's interesting that they phoned with an offer, I sent BOS my LBA yesterday for £940, (first of a few claims through scottish system)

hi. i have sent my first letter to the b.o.s and recieved the usual ****e leaflet and standard letter saying sorry you aint happy bla bla. sent my l.b.a on the 11th jully got a letter saying sorry to hear you have hed no further response to your recent complaint. complaints of this nature are delt with by our customer relations. i can confirm that this matter is still beeing investigated. i would expect you to have a full response within the next 7 to 10 days. letter dated the fourteenth. bring them on. £4800 is a big carrot to chase. dont let the bastards bring you down.

Oh yeah, 4800 is a biggie. My LBA went out just recently, but since I'm having phone issues, I doubt I'll get a call. Maybe a few days ahead of you, but with my non Bank schedule, I might drop a few.

Hiya folks...

 

Received a letter this morning from the BoS,(2 days AFTER the LBA deadline) offering me £495 as a full and final settlement!! The cheek! That's just over 10% of what I am claiming for. (they now owe me £4664!)

 

Went to the sherriff court yesterday to find out about starting the claim process. The sherriff clerk told me I was wasting my time trying to go down the small claim route as I am claimimg for such a large sum. He told me to start an Ordinary Action against the BoS, but this involves getting a solicitor. Help!! I couldn't affort that at the mo. I don't know what to do!!

Advice / support would be gratefully received. I really need this money back, or Hubby and I are well and truly screwed!! Plus, I have come this far, and I am DETERMINED not to give up!!

 

Also, does anyone have a template for how to politely tell the BoS to shove their puny offer where the sun don't shine?!! I am no good at wording these things myself!

You can either sever your claim into batches of £750 and do one batch at a time under Small Claims, or split it into batches of £1500 and go down the Summary Cause ......

 

Summary Cause does have a higher risk in as much as IF you lose the case the bank can reclaim some/most of their costs ..... small claims they cannot claim back their costs ...

 

I'd do some research into both options and decide which was is best for you.

 

Personally I have commenced a small claim, to gain my confidence and will then hit them with a summary cause on round 2 ;)

Thanks for that. One more quick question. Can I serve more than 1 summary cause at the same time, or do I have to do the one after the other? The way things stand I would be looking at 3 summary cause claims and one small claim. It would be a lot less hassle if I could just do them all at once.

you would need to complete one before commencing action on the next or you run the risk of the bank contesting that they all be classed together, taking you out of summary cause and into ordinary cause, which requires legal representation, and large legal bills.

 

Best to sever the claims and take your time ... not convenient I know but best in the long run.

Just as I had suspected. Will start the process on Monday. Wish me luck. I'm starting to lose my bottle a little, but I am determined to get this money back. After all, if it wasn't for the BoS taking all these charges in the 1st place, we wouldn't be in the awful financial situation we are now. :evil:

Hi folks

Haven't been very well over the last couple of days, so I haven't actually got around to starting any Summary Cause claims yet. I was wondering about going down the Ordinary Action route though. I can't really afford to wait that long to get my charges back, if I was to break it up into chunks of £1500, as we are really struggling at the mo.

If anyone could advise me it would be really appreciated. I was going to contact the local C.A.B to see if they could help me.

I will be continuing in my quest to get these charges back in full, by way of court action.

You have a further 7 days, in which to respond positively. If no such response is received from you within the said 7 days, I will commence court action without any further notice or communication. In this case I will be claiming for the full amount of £4703, plus interest at 8%, plus my costs of raising the action.

If I were you, and I'm in a similar position I would just go ahead with the first claim but via the small claims route! I would edit the letter to say no thank you to the offer but that you are now proceeding with court proceedings without further notice as they already have had 28 days and I don't see any benefit to giving them 7 days further notice. If you do file court papers you can now also claim the 8% interest which will probably be quite a substantial amount so probably is worth going for it.I was hoping BOS wouldnt pay up before I filed court papers as it's £3300 I was asking for at LBA stage but nearly £5000 with the 8% interest included.

Thanks for that. I amended the letter and sent it away this morning. I too was hoping that the BoS would see sense and settle before I had to go down the court route, but seems like that's the only way to go. I have decided to give the local C.A.B a call later this afternoon (only open 3pm-6pm) and see what they say about Ordinary Action. Then, I'll commence which ever type of action. They currently owe me £4703, and with the interest it goes up to over £5000. Quite a large sum, and they had the cheek to offer me £495!!:eek:

Good for you Maggie,

 

Sorry I haven't been on here much over the last few days, family life and training courses have taken me offline a lot.

 

It'll be interesting what CAB say about the Ordinary Cause, my concern would be that the costs involved in hiring lawyers to act on your behalf would eat into your money that it may prove to be fruitless, but I do understand completely your frustrations with needing the money quicker ....

Tink, the C.A.B said basically what I knew anyway, but the woman was lovely, and she laughed out loud when I told her how much the bank had offered me!! She wished me the best of luck.

I have contacted a solicitors office today, just asking a few questions. I'm just waiting for them to get back to me. Sooo we'll see what they say, before any further action.
