They took my name/ address/ a picture of me holding a signed banned letter. the only questions I've got are... will I be contacted by the police will this be recorded as police caution or criminal record?  I would really really appreciate if you could let me know how it went.  I am so so so ashamed of myself and am really making changes in my life I feel like I've lost myself for a period of my life but anyways it would be really great to hear back.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, i have recently received a pcn for the following contravention:

*failing to drive shown by the arrow on a blue sign (proceeding in the wrong direction)* in great russell street wc1

 

i subsequently rang them asking for help viewing the video evidence which is apparently available. i also asked the person on the phone precisely which junction, etc the alleged contravention happened, he said he was unable to tell me as it does not say. all the pcn says is *great russell street wc1*

 

they have attached 4 images to it and also sent me further images that i requested via email, however none of these actuall show the the alleged sign which says no right turn. where it appears i have turned right.

the pcn says you can view the evidence online, however whenever i try to do this, it comes up with an error. they replied with an email saying i can call them and they will send me a cd with this evidence.

 

2 questions..

1: if the video evidence doesnt actually show the sign saying no right turn, is the pcn valid?

2: can they charge me for this copy of video evidence?

 

i have only ever driven to london twice and on this occasion, it was late, (22:47) and there seem to be signs at the end of every junction in london, for a relatively new driver, it is quite overwhelming.

Good question about the evidence. theoretically if you challenge it then it is up to them to prove a contravention took place. Get that vid evidence. Sometimes they charge but from what you said about the failings of the website I'd be arguing about any charge. It's normally a cockle but refundable if your appeal is succesful.

 

really need to see all of the PCN please - and all the images.

Question I have just received a PCN that the alleged traffic contravention: Failing to drive in the direction shown by the arrow on a blue sign(proceeding in the wrong direction) in GREAT RUSSELL STREET WC1,when I tried to register the PCN number and registration, nothing comes up the four images I have are 1) the front side of my vehicle, 2) the side of the vehicle, 3) the back of my vehicle,4) the back end of my vehicle driving alongside a silver cab, now I know Great Russell street and can not see any sign, if the sign is hidden by a lorry for instance can I contest.

I will be driving down there tomorrow to double check but can't see how I would commit this contravention, any tips?

Was there a blue arrow on the street you turned into Great Russel Street from?

 

Certainly, on the other thread, they seem to have issued the ticket as if the sign was on the street turned into when, in fact, it was on the one turned out of. If so, as you've pointed out, they're alleging an offence which is impossible to commit and you should have a good chance of challenging it - but will almost certainly have to take it past any internal appeals they offer.

Hello,

I have received a pcn at the same location i.e. Great Russell Street WC1, junction where u are not supposed to go right which i did. Can anyone tell me wheather any one had any luck in this location at all. It all seems a bit dodgy as there are no signs saying you can not turn right and the blue arrow sign is not well lit up or very prominent either.

 

Please can anyone advice if there are any solid reasons someone can use to avoid paying PCN at this ocassion.

I won my PCN appeal at this junction. My grounds for appeal were that I was following diversion signs posted on the roadway which directed me towards Bloomsbury Street. I argued that roadworks signs and diversion signs take precedence over the permanent signs such as the 'ahead only' white arrow on a blue sign. I also argued that the diversion signs also made the existing, permanent signage of the 'ahead only' direction very confusing to the driver. The DVD evidence also was unclear as to exactly where I had :violin:turned right. But, I also had a very sympathetic adjudicator who accepted my arguments and cancelled my PCN. Hope that helps. Have you had any luck in contesting your pcn for Great Russell Street? I have exactly the same notice for turning right off Great Russell Street. It was late at night and my first time driving in London so had no clue at the time until receiving my notice. I can't even remember travelling down that road so not sure how well signposted it is etc.

hey, i didnt have any luck im afraid and had to pay the penalty. they are really tough as they have video and photographic evidence to support them with no room for any escape.
