Hi, was wondering if anyone could give some advice, i've got to the stage where i need to complete MCOL but i can't afford the payment right now, can i hold out for a month until next payday or do i really need to stick to my timescales????

Wait until you can afford it, I believe it's better to file at your local County Court as all MCOL claims are automatically stayed.

Im trying to complete the N1 form and have got stuck. Does anyone know how i calculate the value for:

Interest under s.69 County Courts Acts 1984

 

Is that supposed to be the daily interest rate???

This is your 8% interest. If you used the spread sheets from here it works it automatically for you.

 

If not then this calculator will work it out for you..

Take your charges and times them by 0.00022

 

£1,567 X 0.00022 =34p

No. The overdraft interest is very difficult to work out, this is the reason most people don't bother with it. The 8% interest is only added once you file at court.

I feel like im pulling my hair out with this form, I down loaded the N1 form and typed up all the info that needed to go on it and when i printed it off half the info was missing as it only prints two pages and nothing else. Can any one offer advice

You can print off the forms and fill it in by hand.

Or if you are still having problems, you can always go to the county court and they will give you a copy to fill in.

 

Make sure you make 3 copies of everything. ;)

Have filed my court papers and today recieved two letters from wragge&co, the first was to let me know that they intend to defend and the second a copy of there letter of defence that they have sent to the court. Does anyone know what happens next??? is there any advice on what to do in court?

The court will more than likely 'stay' your claim, tell us when they get in touch.

Hi people i recieved a letter from Birmingham County Court yesterday stating

 

The defendant responded to the claim indicating an intention to defend all of the claim. The defendant has 28days from the date of service of the claim form with particulars of claim, or of the particulars of claim, to file a defence. The acknowledgement was filed by the solicitors acting for the defendant who have given the following name and address for service of documents Wragge & Co

 

I recieved a copy of Wragge & Co's defence on the same day as i recieved their acknowledgement of service.

 

Ok people now i'm quite stuck because i cant find information on what to do when i go to court, can anyone advise me please.

The court will now more than likely send you a letter saying the claim has been stayed as Scott says, within the next couple of weeks.

 

If they don't stay it, then they will send you an AQ to fill in, but don't worry, we will help you with it. Have a look at this link.

Hi Sea-side lady, I have recieved the Allocation Questionnaire from the Court, which is requesting a fee of £200. I cant afford this fee so am most likely going to have to pull out and let Alliance & Leicester win. I am so annoyed....

There is still a really good chance they will stay the claim, just hang on a few days to see if you get the letter.
