    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello T99!

 

I regret if that is all one Document, it looks to have all of the Prescribed Terms and other Details to make it Enforceable.

 

However, I did see you have NOT ticked PPI, so did they charge any PPI?

 

Likewise, are there any Penalty Charges on the Account that you can seek a Refund on to try and lower the alleged Debt?

 

If you have no Statements, then it could be worth £10 to send them a Subject Access Request to obtain Copies, and any other detail that might be useful.

Im not having a lot of luck with my returns , there is penalty

charges ect so will send SAR tomorrow , they have defulted

me on this as well :eek:

UPDATE

 

Have today received a letter from Mr Tesco;

 

"Following a review of your account we are no longer able to

except your current level of payments.£1.00

The minimum payment we are prepared to except is £==.==

if you cannot increase your payment to this level, please complete

the enclosed Financial Statement and return it to us now. This will

help us to assess your financial situation and is completely confidental."

 

Now I sent a SAR to Mr Tesco on the 12.05.08 no sign of any Data

will write back and say when I get my statements , then maybe we

can reduce the debt by them giving back the charges ect .

Hello folks

 

Update on this one

 

Have been trying to get Tesco,s to take money of me

for months now , have sent financial statements and letters

to them they just do not reply:?

 

Then they get Triton Credit Services on to me well dont know

about anyone else ,but these are the worst by far they dont do

anything exept write Defaults and demand money to be paid.

Have just written again enclosing copies of all letters I have sent

and not had a reply to and asked if I could please get a D/D set up,

also added at the end please note I will only communicate with your

company in writing.

 

We shall see what happens next

Hello all

 

Update for this one

 

Received a letter from Triton to say we cannot except your

I/E sheet as it includes business expeniture and yearly accounts

well have written back to say that RBS have given me a paying

in book and they had exactly the same information as you .

Tesco are part of RBS so whats the problem , only differance is

Moorcroft are dealing with RBS card and in fairness to them have

done everything by the book.

Hello all

 

Update for this one

 

Have sent so many letters with offers of token payments

to these people , have sent I/E Business Accounts lists

of all the Creditors with their offers confirmed .

Now have received a letter from Green & Co Solicitors to say

that they will be taking me to court if i dont respond to Triton.

How many times do i have to say I have a Business and dont have

any Income from it , they have now sent their own Budget sheet

for me to fill out .

Will be sending it back to them with the same info as they have

already got three times before .

Update

I have received yet another letter from Triton saying

"In your recent letter you have stated that you have no income

and this is why you have not listed this in your financial statement.

If this is the case, we require you to explain how you cover any

essential monthly expenditures and how you are able to offer a

monthly repayment of £xx

This information should be received in our office within 14 days."

 

I have a Business and pay from the cashflow as it comes in maybe

they will except nothing then .

I have to say they have been at me to pay them for months and each

time I offer a token payment they keep asking for I/E which I have sent

and then I sent my Buisness accounts what more can i do .

Am writting to them yet again explain this is what i can afford and am enclosing

a P/O with the letter .
