      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wonder if you could use a 'poste restante' address at a local post office. I did this a lot when I was travelling abroad and presume there is some similar setup for people travelling in the UK. Worth asking the post office.

Hi Jaws I would suspect that the form means you can't have more than one basic bank account, as I am sure you can have as many bank accounts as you want otherwise. I think your Barclays account will be loaded up with unenforceable charges since you abandoned it:p

I wouldn't worry too much. After all if you are a lodger with no assets what can they do? If they do track you down then you can refuse them permission to visit the house, they won't have your phone number, so let battle commence.;) You will have to come out of the woodwork one day.

Does it say on the letters sent to your folks how much the bank overdraft is now?

 

I think it's ok to say 'correspondence only' and use your friend's address. After all if you are going to sort out charges etc you will need to receive letters from people;)

Hi Jaws, I just wondered how much had been added in charges since you last had any dealings with the bank.

 

Re the 'correspondence only' I was unsure whether the banks would accept that as a 'proper' address - that was my only concern. I suppose I was also concerned about DCA visits, although having said that I have had threats of DCA's calling on me many times and not one has ever shown up:D

Hi again, sorry been out all day. In the olden days I would have suggested that you could strike up a deal with the bank and get the account back in action. However now with all these activists :D claiming charges back the banks are not normally keen to negotiate in the way they used to. I had a natwest account that had £1000 of charges which were totally uncalled for (I was a quid short to pay a £5 dd to the RPSCA) and then just ignored the account and watched the charges grow. Eventually they refunded all the silly charges and we carried on our banking relationship happily ever after.

 

It might be worth a phone call to the bank - presumably your account is now with the debt management unit and they might be able to sort things out. I am really not sure how to advise you on this, presumably life is a little difficult without a bank account and if your folks are starting to get letters it doesn't help. Depending on which bank it is and who you actually speak to will unfortunately have a bearing on things as well:o. But if you come up with an offer to repay the original debt chances are they will consider refunding the charges.

Hi Gill, I had a farewell letter in June 07 re MBNA and have heard no more. Just started to stir things up cos between MBNA and Lowells there are 4 defaults on my credit file for the one debt, so I have emailed Experian and asked for three of them to be removed. Should really have asked for them all to be removed as there is no CCA but I would be quite happy if three of them went the distance.

Decisions, decisions;).

 

I think Plan B sounds about right. I am not sure if you open a new bank account whether that will trigger things with the CRAs in the same way that asking for your credit report would. In which case your gradual progression to Plan A might happen a bit faster than you expect. :eek:

 

I know you can search the London Gazette online and you might be able to find out if you have been made bankrupt in your absence. This is a link to their site:

I thought that was an excellent observation - the substitution of the word 'debt' for 'credit' - people would be less inclined to borrow money if the adverts said 'increase your debt with us...'.

 

I doubt that anyone will have made you bankrupt by the way. Happy hunting.

Jaws I have three of those that say XX vs Goldlady and am fighting them at the moment. At the same time I have one that says Goldlady vs XX (same company) - they offered me £1000 last week and I said 'no' - couldn't believe I said it but they actually owe me £2000 so I am holding out for the full amount.

 

It all becomes a bit of a game once you have taken them on. As you have learned there are charges to reclaim, unenforceable agreements to argue about - it is a lot of work, but if your credit rating is stuffed anyway, as mine was, then what have you got to lose?

 

I am drinking a bottle of whisky my friend gave me for saving her £20K on her mortgage through mis-sold PPI. And preventing her house from being repossessed.

 

It is all about fighting back. I almost went bankrupt 18 months ago and would have done it until I found out that most of them didn't have enforceable CCAs. So whatever I manage to achieve is a bonus if you see what I mean:)

Hi I'm new on here too, and since I posted a thred on here not long ago I have so much more confedence to deal with my DCA's. As when your at home not anwsering the door because you think its one of them, and it turns out to be the little lady next door, or you wait untill somebody else comes home to pick the post up. (even though it is jut a letter)

I still hesitate before I pick the post up or answer the door - and I still use 1471 rather than answer the phone. :o Even though most of my credit baggage has been well and truly disposed of...
