      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You will get a letter offering half iin the morning i should think.

 

they will offer half, so you may want to draft a responce saying that you will only take full amount. they will accept the responce by fax aswell. i got a letter offering full amount yesterday - two days after they got my reply stating i would accept half as a downpayment and take them to court for the rest...........not long to go now.....

Doesn anyone have any idea what I should say in the letter of responce. Luckily I have a fax machine at my work so will use that to send responce

i faxed mine to them and that was fine

 

I just put the following

 

Dear DG

 

Thankyou for your offer of £****, i will accept this as a partial settlement but will carry on with my claim for the full amount.

 

If you would like to discuss this further you can do by contacting me in writing or via ***TEL NUMBER*****

Is that what I really want though? i would like it to be settled, rather than dragging on. Couldnt i say thankyou for the offer, but if you dont pay the full amount then I will be forced to continue my claim?

they offered me full amount 2 days later I wroyte that i would accept that as partial settlement and continue my claim just as it would be deemed as resonable in court.

 

You can always write that you decline there offer and will carry on your claim for the full amount - they will offer you full withing 2 days again so same T/A

 

Its up to you but i dont think either way is quicker from the posts ive read

Payment went in my closed account last night, it will take 3 days to transfer in my normal halifax account. your 6 days behind me so in therory you shoud get your money on the 7th (is a sunday so maybe the 6th if your lucky of the 8th if they are dragging it out a bit) no matter what it should be in your account within the week, so it may be a couple of days into your holiday.

 

i reackon you will get your full offer tommorow

Just look at at all that money they took as a forced savings scheme at 8% interest minus the stress it caused you of course

The thing I would like to know is:

 

I have made a claim, won the claim but they havent asked for when I have been charged and so on. They havent had the excel spreadsheet that I created so couldnt anyone claim?

 

PS - to the people who have won, how long till it goes into my account?

Firstly CONGRATULATIONS!!!

 

as DG work for first direct they actually use the same systems as FD and HSBC so they can access your accounts. So they would have checked the charges alredy or they would have disputed this so dont worry about not sending it.

 

Secondly, i sent back my confirmation and they rec'd it last thursday, the money was in my account monday evening so as long as you sent yours back today you should have yours sat if your lucky if not mon/tuesday.

 

so you only have about 5 days till payday ;-)

 

You will rec'v a letter stating that the money will be in your account in the next day or so friday/sat aswell.
