    • Hi All, I'm looking for help with a P2G claim for another lost parcel. Given the wealth of information on this site, I'm hopeful that this should be an easy one to fix, but want to be sure I have everything. On the 6th March, I contracted with P2G to send a parcel (a £600 Pioneer AVH-Z7200DAB car stereo which is not on either P2G or EVRi's excluded from compensation or prohibited items list) using EVRi, sent it off, and that was the last I heard of it. The EVRi tracking showed that the parcel had made it to the national sorting hub at 2:12 on the 7th, and then vanished. By Friday, I had started to get nervous, and so, raised an enquiry. And then another, and another - well, they weren't responding, and I couldn't get their telephone one to work, I think in all, it was more than 15 enquiries. I also raised an investigation with P2G as well. EVRi closed the enquiry confirming a loss on the 19th March, and P2G near the end, although P2G closed it claiming that I needed to send photos of the parcel as proof - which I didn't have, and I also do not have an account with P2G so couldn't upload anything (I did test, just in case), and this is why despite receiving advice on the EVRi Fb group to send the letter before claim, I haven't yet acted. I have proof of the eBay listing, and the refund, to demonstrate that which was being sent, but P2G's insistence that I have no photographic proof of the parcel with the label - I have the photo of the goods in their box before sending, but this is for the eBay listing, and so does not show it after the fact. This I fear is what P2G will seek to rely on as a defence, hence my 10 week delay on progressing with this. But, I am more than £600 out of pocket for the loss: £600 for the item and £8.04 for the delivery fee, although my claim will actually be for an initial £611.09 to cover the cost of the loss, their delivery fee, and my 1st Class Recorded stamp for the Letter Before Claim to P2G, rising to £681.09 to cover the additional £70 cost of opening the court case if they fail to respond within 14 days. This question mark surrounding P2G's request for photographic evidence, is this likely to cause me a problem? Steve
    • Had a letter response today dated 12/6/24 from PRA Group re request for information consumer credit act 1974. Confirming they are in receipt of my CCA letter request - and that they are requesting the required information. They returned the £1 postal order. And my CCA letter. Stating that they will contact me with an update ASAP. They attached/included a standard ( non personal ) page about ' what they should provide ' and ' what happens If I don't get this information'.    I need to file my defence by 21 June 24. Any suggestions as to what that defence should be ?   
    • Thanks @dx100uk for responding promptly.    To be quite honest with you, applying for breathing space might not really help except some short term relief. I don’t want to default either as I might lose my job too and I cannot really afford it. Sorry for sounding bit stupid but is there something I can do to stop them charging interest and agree on reduced payments? I am working on information that @BankFodderhas requested and will be sharing it later today.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a few questions regarding the things you should and shouldn't tell DCA's

I'm currently on Job Seekers Allowance, as a result I have 4 debts that I'm still trying to bury with non CCA compliance.

 

I made a point of telling them I didn't own property. (moved back with parents 6 months ago.), I have no car, (I do, but they have no way of knowing from any info they may have and car is now registered in my dads name anyway as I "sold" it to him for a quid. ;) .) On the so called "agreements" for my loans it says it was for consolidation of existing debts, the only fly in the ointment was £2k on a credit card, but I didn't actually buy much in the way of material things with it, most of it went on binge drinking, and enjoying life. :D Ahh the good old days.

 

So if I play it dumb and tell them nothing else I should be safer from a CCJ than I thought I was before starting to read this excellent thread?

I understand what you saying ( I have no assets), although if you did provide a budget did you include Fuel, car insurance, tax, mot, etc.

 

Unfortunately, what you have said does not rule out a CCJ, because the first step in going for a CCJ is to get a payment order in place in order to get monthly payments out of you, which is more than they are getting now.

It's is only AFTER that arrangement defaults that they will be interested in any assets you own.

Yes, they will assess your potential assets but their first priority is to get regular payments out of you, and if you do have assets they will hope you default.

 

On my budget sheet I was as vague as I possibly could be. I just put travelling expenses. I've learnt fairly quicky after sorting out my girlfriends debt probs last year, that it's best to tell them as little as posible.

For the ones they have complied with the CCA for, I'm paying token payments of £1 a month.

It's because the poster said he spent the money on "binge drinking and enjoying life" so it was not free like a walk in the park, otherwise there would be no debt.

 

I was being honest when I wrote it. I spent money I didn't have and paid the price for it. Hands up and admit I was stupid. Even with no CCA's you're still under tons of pressure and stress from the DCA's. I send out about 12 letters a week for myself, my girlfriend and a few good mates who also made the fatal mistake of "easy credit". A lot of work, but well worth it when you can see the light at the end of the tunnel.

 

It's a trap that's easy to fall into. Now I have no money, job, or material things like that, I have realised there's far more to life than posessions and going out. Got my bike out of the shed a few weeks ago, spent £20 on new tyres and innertubes, cleaned it up a bit. Since then I've been to lots of places, seen more things than you ever would driving a car, and best of all. It doesn't cost a penny + keeps me fit too.

 

Don't ever say that being in debt/losing your job is the end of the world. Fo me it's the start of something better. You just don't realise it at the time. :)

 

It's all too easy to get caught up with the constant media brainwashing we all get from TV, etc, that you have to have, or need the latest gadget or car, etc. You don't.....Quality of life is a million times more important than the bank balance or a house full of the latest kit.

 

When it comes to DCA's and CCA's. If I couldn't provide the correct paperwork, I'm sure they'd have no hesitation to screw me for anything they could get and in any way they could. So my motto is. Do it to them, before they do it to you.

By the time the "specialist" DCA's come out of the woodwork, I'll be 5 and a bit years wiser to all this. Got them all on the run around after just over a year, so another 5 and they deffo won't have a hope in hell.

 

The only way any of them will see another penny from me, is if I decide to send one with unpaid postage, so it costs them a quid to get it. :D

Whilst I'm not claiming it was due to me & my threat of litigation, I have heard that the CRA's are or have already introduced a new code of practice whereby their clients will have, if required, to provide evidence that the data is accurate.

 

In fact I think they have recently been reminding clients that it is their duty to ensure the data is correct failing which they could be sued by the subject & have their CCL called into question

 

Just a shame that codes of practice are made to be broken.

I think we should put it to the test and insist that defaults

where there is no CCA produced should be removed by the CRA's.

Last time I tried I got back the bog standard "The dca say the information

is correct, so it must be true, and it's staying on your file." Type of letter.

 

When you realise that the CRA's also own a few DCA's and it's getting obvious to many on here, that they do share data and work together for their own benefit (deffo not for the people)

Lots of people have sent off their £2 to a CRA for a copy of their credit file, only to get a DCA contact them a few weeks later for a long forgotten about debt. It happens far too often to be a pure coincidence.

My girlfriend recently sent for a copy of her credit file.

Within a month she was contacted by Westcot for an old

Freemans catalogue account. and a few days later by

Buchannon Clarke and Wells for an outstanding balance

from an outstanding gas from about 3 years ago.

 

Bog off letters sent by return post and all is now

peaceful again. :)

It's best you start your own thread on here, then it will be easier for everyone to advise you on what to do. Otherwise everything will end up lost amongst the other posts on this thread, and make things complicated for everyone.

 

Send me a private message when you have your own thread going. Then I'll try and sort out what you need to do next. Any chance you can provide up to date info on your new thread , on which DCA has each account, what each one is for (loan, Credit card, catalogue, etc) plus approx amounts and what year the credit was taken out for each one? Doing this will be a big help.

Jorja is fine drinking 7 oz bottles at 9 weeks old and putting on weight. She is suffering a bit with the weather as it cant make up its mind but we can help that. Chrissi

 

My chinchillas don't like the hot humid weather either. Imagine wearing a 2 inch thick fur coat. Yet they sleep togther in a big furry pile with a few legs,ears, and whiskers sticking out.

I used to breed them. But just keep a few as pets now. The baby one in the pic is now 5 years old.

Seriously though, chinchillas make good pets if you get them from a breeder instead of a petshop. Buy them young from a breeder and get them used to being handled from an early age. They are also very intelligent like squirrels.

 

They also live to around 25 years old, so no upset kids every 4 years like you get with rabbits and guinepigs.

Also chinchillas don't smell and only need cleaning out once a fortnight. If you get a proper cage where everything drops through a mesh floor onto cat litter/compressed paper pellets in the slide out tray.

 

They need to be kept inside in a dry enviroment, as they cannot cope with damp or wet. If exposed to wet or damp, they can get breathing problems.

 

Like mice and gerbils they need something to chew on to keep their teeth from growing too long. Bits of wood and cardboard are ideal.

 

Chinchillas don't wash their fur. They need a dust bath. This is a metal box filled with volcanic sand that most petshop can provide. A chinchilla rolls in the sand and it keeps their fur clean. They don't suffer from fleas, as their fur is so dense fleas can't get down to their skin to feed. Most furry animals have one hair per folical. Chinchillas have about 8.

 

They moult their fur twice a year, and it's so fine it looks like cobwebs and floats in the air. Once a week, run the vacuum cleaner around the cage and it won't be a problem.

 

They make excellent and unique pets. A real conversation piece for anyone who visits. The initial cost of the cage, etc, isn't cheap (£100) and a chinchilla will cost about £50 to buy (70-80 for a charcoal black one), but they live a long time, and well worth the initial cost.

Once you have the cage and accessories, one chinchilla will cost about £5 a month to keep.

Thanks for that one FB - we have moved from 'inside a DCA' to 'inside a chinchilla cage' which is actually a much better place to be IMHO. :D

 

Unless you happen to be a ryvita, sultana, or a smartie.

 

Then you'd be in real trouble. The pic above shows chinchillas like ryvita, but they have a real sweet tooth.

I have to agree BB.

 

Recently my friends son was mugged. Threatened with an iron bar and had his phone stolen and £15 in cash.

My friend knew who was responsile and called the police.

 

Almost a WEEK later they came to the house to get a statement. My friend commented that the person responsible was a local drug dealer an was the dregs of society. The police woman got really stroppy with him and accused him of being racist as the person who had mugged his son was Asian. :eek: She then went on to say that she felt sorry for him as people were always accusing him of petty crimes in the area. :eek:

 

Of course it's been 3 weeks now, and what have the police done? You got it. Zero. Around here they're too busy pulling motorists for faulty lights and other easy targets rather than the real criminals.

My mate was in the police for a few years in the 80's, so he's filed a complaint about the attitude of the officer and the fact that nothing was done either.
