    • Hello everyone,   Just thought id post an update.   I've today now finally received a claim form from PRA Group. Bit annoying as the last payment to them would have August 2018 so was nearly over the line. I believe my only grounds for defence is that they haven't managed to produce a copy of the DN notice, however from some online research I managed to find some case law that stated they can use their systems screenshot to show proof of it being sent.   I know I have to respond back to their claim form and will do so online on moneyclaim, is now the time to pick up the phone to them and negotiate a deal?   Any advice as always is much appreciated it.

I'm also concerned because the property has detoriated since I've been here due to mould, damp and rusting (which I've never seen in a property before) rusty hinges and other damage to the front door caused by damp and mould, I'm concerned they could try and charge me for damages? As long as you've documented and reported this previously you'll have a right to challenge any costs. There was no inventory when I moved in, I also didn't have to pay a deposit. Do an inventory when you move out as proof of the property's condition as you leave it. I've also been told that if I leave before a possession order is given I would be deemed intentionally homeless, is this true? If you leave, yes. However, Your local council has a legal obligation to ensure you won't be left homeless as soon as you get the notice. As stated before, you don't have to leave when the notice expires if you haven't got somewhere else to go. Just keep paying your rent as normal. Your tenancy doesn't legally end until a possession warrant is executed against you or you leave and hand the keys back. My daughter doesn't live with me, I'd likely have medical priority as I have health issues and I'm on pip etc. Contact the council and make them aware then.      
    • extension? you mean enforcement. after 6yrs its very rare for a judge to allow enforcement. it wont have been sold on, just passed around the various differing trading names the claimant uses.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think disturbances of whatever form should be regional, then people can support easily and I think it would have greater effect....especially if it was publicised through out the country... if anyone has friends in the media...

 

driving slowly means nothing too people if we have template a4 posters that we put in car windows so people know what we are doing maybe... they will support also.. the masses can change things if they all want for similar things... all people need sometimes is a leader...

 

let us regionalise various protests, come up with when, where and how(legally) and publicise for maximum effect... I am all for marching on government but we need a comprehensive list of proposals we want them too look at immediately or we take action in to our own hands... it seems as has been discussed this is all they listen too... 10,000 marching on no 10 downing street would make people sit up and see things need to change...

Only direct action by the masses will work....

hi revolting peasant.... please give us your alternative suggestions then....any ideas would be listened too.... shall we just continue as we are...

we are being milked from all angles fromin a whole host of guises..The well paid are even better paid..... when we win one victory they just put in another milking machine.... when I receive a payrise I expect it to give me a better standard of living as I have worked hard to get it. All I see is I owe more and pay more in all host of taxes.... apart from moving to another country or giving up work and milking the system what alternatives do we have... this country is a mess....

maybe the government would be more inclined to use our money more wisely and not squander billions of pounds. they need to be more accountable to how they spend our money until this day we are in a vicious circle of rising everything apart from wages.... which means more poverty for the masses

HI maybe try this site this is direct link to your local MP and They do reply. If people feel MP's are the wway then try this.... lets try all avenues...

 

I am starting to feel like we are becoming a scene from the life of Brian, apart from sanitation what have the romans ever done for us.... the JPF talked a great deal about rebellion but didnt really achieve much. If anyone is a fan they will know what I am talking about.

 

I would just like to say I think CAG has achieved quite a lot for a great number of people although I also feel that with co-ordination it could achieve so much more. I would be happy to donate say £1-£10 times by 170,000 could be used for people to make this site more effective or pay some solicitors fees etc... the only thing this government will listen to is the masses... the police and the army are is P***ed off as we are and as long as we have a strong argument for what we do I can not see any of us being shot... probably more chance of being shot in any high street in most cities....

We are hitting £111.9 a litre in some areas now, soon we will be faced with paying £1.20 a ltr.

 

 

 

This makes MUCH MORE SENSE than the 'don't buy petrol on a certain day campaign that was going around last April or May! The oil companies just laughed at that because they knew we wouldn't continue to hurt ourselves by refusing to buy petrol. It was more of an inconvenience to us than it was a problem for them. BUT, whoever thought of this idea, has come up with a plan that can really work.

 

Please read it and join in!

 

Now that the oil companies and the OPEC nations have conditioned us to think that the cost of a litre is CHEAP, we need to take aggressive action to teach them that BUYERS control the market place not sellers. With the price of petrol going up more each day, we consumers need to take action. The only way we are going to see the price of petrol come down is if we hit someone in the pocket by not purchasing their Petrol! And we can do that WITHOUT hurting ourselves.

 

Here's the idea:

For the rest of this year DON'T purchase ANY petrol from the two biggest oil companies (which now are one), ESSO and BP.

 

It's easy to make this happen. Just forward this email, and buy your petrol at Shell, Asda,Tesco, Sainsburys, Morrisons Jet etc. i.e. boycott BP and Esso

 

If they are not selling any petrol, they will be inclined to reduce their prices. If they reduce their prices, the other companies will have to follow suit. But to have an impact we need to reach literally millions of Esso and BP petrol buyers. It's really simple to do!!

 

Now, don't wimp out at this point... keep reading and I'll explain how simple it is to reach millions of people!!

 

I am sending this note to a lot of people. If each of you send i t to at least ten more (30 x 10 = 300).... and those 300 send it to at least ten more (300 x 10 = 3,000) . and so on, by the time the message reaches the sixth generation of people, we will have reached over THREE MILLION consumers! If those three million get excited and pass this on to ten friends each, then 30 million people will have been contacted! If it goes one level further, you guessed it... .

 

THREE HUNDRED MILLION PEOPLE!!!

 

Again, all You have to do is send this to 10 people. That's all. (and not buy at ESSO/BP) How long would all that take? If each of us sends this email out to ten more people within one day of receipt, all 300 MILLION people could conceivably be contacted within the next 8 days!!! Acting together we can make a difference . If this makes sense to you, please pass this message on.

 

PLEASE HOLD OUT UNTIL THEY LOWER THEIR PRICES TO THE 69p a LITRE RANGE
